[ RESOLUTION CHR (IV) A2009-053-C, May 18, 2009 ]

CHR CLEARANCE SYSTEM



WHEREAS, Article XIII, Section 18 (2) of the 1987 Constitution of the Philippines mandates the Commission on Human Rights (CHR) the power to “adopt its operational guidelines and rules of procedure xxx”;

WHEREAS, pursuant to said Constitutional mandate, the Commission promulgated Resolution CHR (III) NO. A2005-153, dated 16 November 2005, on “Adopting the CHR Clearance System”;

WHEREAS, there is a need to make more effective the existing CHR Clearance System;

NOW, THEREFORE, the Commission hereby ISSUES the hereunder clarification to the above mentioned Resolution, as follows:

SECTION 1. CHR Clearance, Who are covered. A CHR Clearance shall be issued to the following applicants;

a. Those who have no record of human rights violation case/s filed against him/her before the Commission;

b. Those who have no pending human rights violation case/s filed against him/her before the Commission; and

c. Those whose human rights violation case/s filed against him/her before the Commission have been dismissed.

SEC. 2 Issuance of a CHR Certification - All others who are not covered by Section 1 shall be issued a CHR Certification. Such certification shall certify only as to the applicant’s standing in the Commission.

SEC. 3 Effectivity Clause - This resolution shall take effect immediately.

Let copies of this Resolution be furnished the University of the Philippines Law Center for publication and recording, and other concerned agencies as mentioned in CHR (III) No. A 2005-153, dated 16 November 2005, for information.
