[ ERC RESOLUTION NO. 17 S. 2009, July 13, 2009 ]

A RESOLUTION ADOPTING THE UNIFORM REPORTORIAL REQUIREMENT (URR) BY ALL DISTRIBUTION UTILITIES IN LIEU OF ERC DU-MO1, ERC DU-M02 AND REPORTORIAL REQUIREMENTS IMPOSED IN VARIOUS AUTOMATIC ADJUSTMENT MECHANISMS



WHEREAS, Section 4 (q) Rule 3 of the Implementing Rules and Regulations (IRR) of Republic Act No. 9136 empowers the Energy Regulatory Commission (ERC) to require reports or documents from Electric Power Industry participants;

WHEREAS, on various dates, the ERC adopted several automatic cost adjustment mechanisms, which require Distribution Utilities (DUs) to submit every month their respective calculations on generation rates, system loss rates, transmission rates, lifeline rates, mandated rate reduction, among others;

WHEREAS, the ERC saw the need to rationalize these requirements to facilitate its review of the DUs’ calculations;

WHEREAS, on November 21 and 25, 2008, the ERC conducted public consultations for the proposed URR that will replace the ERC DU-MO1, DU-MO2 and other monthly reportorial submission to ERC;

WHEREAS, a Technical Working Group (TWG) composed of the representatives from volunteer DUs and ERC staff was created to develop and formulate a URR to be used by DUs in the calculation of their monthly rates adjustments, as well as serve as the monthly reportorial submission with the ERC;

NOW THEREFORE, the ERC, after considering the various views and comments submitted by all interested parties, hereby RESOLVES, as it is hereby RESOLVED.

1. To approve and adopt the URR excel model with its output data, which shall serve as monthly reportorial submission of the DUs in lieu of ERC DU-M01, ERC DU-M02 and other monthly reportorial requirements, hereto attached as *”Annex A”* and made an integral part of this Resolution;

2. To direct all DUs to implement and comply with the URR submission starting January 2010 by submitting to the ERC in one (1) electronic copy and two (2) hard copies the accomplished URR model together with the supporting documents, on or before the 30th day of the following month; and

3. To undertake information dissemination among the DUs on the use of the URR model to ensure their strict and timely compliance.

This Resolution shall take effect fifteen (15) days following its publication in a newspaper of general circulation in the country.
