COORDINATION WITH THE LOCAL PNP TRAFFIC DIVISION IN THE MONITORING AND REPORTING OF CASES OF VEHICULAR ACCIDENTS



In view of the series of vehicular accidents which resulted to loss of lives and injuries to several others including damage to properties and in order to effectively monitor the manner, behavior and attitude of the drivers on the road considering that according to findings these accidents were caused mainly by driver’s error, your are hereby directed to strictly observe the following guidelines in the monitoring and reporting of cases of vehicular accidents particularly those which resulted to injuries, loss of lives or damage to properties:

1. Regional Directors shall closely coordinate with the local PNP Traffic Division in their respective area of responsibility in the effective monitoring and reporting of vehicular accidents to aid the Assistant Secretary in the exercise of his power and authority to suspend, revoke or reinstate driver’s license pursuant to Section 27 of Republic Act No. 4136, otherwise known as the Land Transportation and Traffic Code of the Philippines, pertinent provision of which reads as follows:

“Section 27. Authority to suspend, revoke and reinstate driver’s license – Without prejudice to the authority of the court in appropriate cases and except as herein otherwise provided, the Director (now the Assistant Secretary) shall have exclusive power and authority to suspend or revoke for cause any driver’s license issued under the provisions of this Act. x x x”

2. Vehicular accidents which resulted to injuries, loss of lives or damage to properties or any traffic violations constituting offenses punishable under the Revised Penal Code shall be reported to the Office of the Assistant Secretary, as they happen, within 24 hours from the time of occurrence through any fastest means of communications (e.g. thru fax machine, email or computer file transfer). The copy of the police report shall also be forwarded as soon as it is available;

3. The report shall contain the following:

a. Name of Driver/s involved and Driver’s License Number;

b. Place of the Accident;

c.Name of the Company or Operator/Owner of the Motor Vehicle/s involved;

d. Other important details such as the number of fatalities or persons injured or estimated amount of damage to properties;

e. Such other relevant information as may aid the Office of the Assistant Secretary in the appreciation of the case should there be a need to conduct an administrative investigation against the driver/s or operator/s involved;

f. Result of the drug test (Note: Under our rules, it is mandatory for drivers involved in vehicular accidents which resulted to injuries, loss of lives or damage to properties to undergo drug testing);

g. Recommendation of the Regional Director concerned.

The action of the Assistant Secretary under Section 27 of Republic Act No. 4136 shall be without prejudice to the imposition of fines and penalties provided for in Item H (75) of Department Order No. 2008-39 (Revised Schedule of LTO Fines and Penalties for Traffic and Administrative Violations).

Previous orders, memoranda and/or instructions inconsistent herewith are deemed superseded and/or otherwise modified accordingly.

This circular shall take effect immediately.
