CLARIFICATION OF FUNCTIONS OF MVICS AND DISTRICT OFFICES ON THE INSPECTION OF MOTOR VEHICLES



This clarificatory Memorandum Circular is anchored on the following fundamental premises:

A. Determination of road worthiness, compliance with motor vehicle standards such as those provided under R.A. 4136, the Clean Air Act, Seatbelt Law, and Motor Vehicle Users Charge Law, among others, are within the intended and established expertise and competence of the Motor Vehicle Inspection Centers (MVICs) pursuant to the purpose of establishing the MVIS;

B. District Offices (Dos) have in their custody the Original Copies of the Certificates of Registration (CRs), Official Receipts (ORs) and other relevant documents, and since the inception of these DOs, the determination of identity based on documents and physical identification, classification, ownership, and the processing of documents have been established as their expertise and competence;

C. There is a need to prevent if not totally eradicate erroneous registrations especially those arising out of applications for Registration of Transfer of Ownership, Duplicate CRs, and other applications requiring physical identification of motor vehicles, by providing a clear delineation of the functions of the MVICs and the DOs; and

D. With the proper delineation of functions, responsibility centers in the performance of specific duties and whatever errors arising therefrom can be easily established.

Henceforth, all inspections for the determination of road worthiness and compliance with motor vehicle standards shall be the sole responsibility of the MVICs. On the other hand, the DOs shall be solely responsible for the conduct of all motor vehicle inspections for the determination of the identity of vehicles based on documents and physical identification for the following transactions, to wit:

1. Application for Registration of Transfer of Ownership;
2. Application for Duplicate CR; and
3. All other applications requiring physical identification of motor vehicles.

All other issuances inconsistent with this Memorandum Circular are hereby superseded.
