[ MARINA CIRCULAR NO. 2009-16, May 04, 2009 ]

RULES REQUIRING PASSENGER CARRYING MOTORBANCAS AND ALL VESSELS FIFTY (50) GROSS TONS AND BELOW TO SUBMIT VALID/UPDATED PASSENGER INSURANCE COVERAGE BEFORE THE ISSUANCE/RENEWAL/EXTENSION OF PASSENGER SHIP SAFETY CERTIFICATES



Pursuant to the provisions of Presidential Decree No. 474, Executive Order No. 125, as amended, and Republic Act (R.A.) No. 9295 and its Implementing Rules and Regulations, the following are hereby adopted:

I. POLICY GUIDELINES

1. The validity of the issuance/renewal/extension of Passenger Ship Safety Certificate (PSSC), pursuant to the provisions of Memorandum Circular (MC) No. 203 on Rules Governing the Implementation of the Ship Safety Inspection System (SSIS), shall be co-terminus or valid only up to the duration/expiration date of the compulsory passenger insurance coverage of the affected motorbanca/ship, as required by the IRR of R.A. 9295;

2. Adequate insurance coverage is an amount not less than two hundred thousand pesos (P200,000.00) per passenger and the total amount of such coverage shall be equivalent to the total authorized number of passengers of the motorbanca/ship concerned, as reflected in the PSSC;

3. Valid/existing PSSCs of Motorbanca(s)/ship(s) covered by this Circular shall be cancelled sixty (60) days from the effectivity of this Circular, unless earlier renewed;

4. The validity of all PSSCs of concerned motorbancas/ships to be issued/renewed shall be harmonized with the expiration date of the passenger insurance coverage, but shall in no way exceed the one (1) year validity of the original PSSC;

5. All motorbancas/ships that are to be registered and proposed to be used in the domestic trade and will be covered by this Circular, due to their size and proposed type of service, shall be issued a certification valid for fifteen (15) days;

6. The certification to be issued may be used in-lieu of the PSSC as a requirement for their application for insurance;

II. PENALTIES

Violations of the provisions of this Circular shall subject the shipowner/operator to the following penalties:

First Offense          -     PhP5,000.00
Second Offense      -     PhP10,000.00
Third Offense         -     PhP20,000.00

III. REPEALING CLAUSE

Any provision of existing MARINA Circulars, rules and regulation, Orders or Decisions which are inconsistent with this Circular are hereby repealed or modified accordingly.

IV. EFFECTIVITY

This Circular shall take effect immediately after fifteen (15) days from publication in a newspaper of national circulation.
