ADOPTING RULES OF PROCEDURE FOR ADMINISTRATIVE CASES FILED FOR VIOLATIONS OF THE PRICE ACT FOR BASIC NECESSITIES AND PRIME COMMODITIES UNDER THE JURISDICTION OF THE DEPARTMENT OF AGRICULTURE WITH THE DEPARTMENT OF TRADE AND INDUSTRY (DTI)



WHEREAS, in the implementation of Republic Act 7581, otherwise known as the “Price Act” and its Implementing Rules and Regulations, the Department of Agriculture has jurisdiction over agricultural crops, fish and other marine products, fresh meat, fresh poultry and dairy products, fertilizers and other farm inputs.

WHEREAS, the devolution of some powers and functions from the national government to the local government units by virtue of Republic Act 7160 otherwise known as  “The Local Government Code of 1991” posed some difficulties to the Department of Agriculture in the enforcement of the provisions of the Price Act and its Implementing Rules and Regulations because its offices are now limited to regional levels only.

WHEREAS, the Secretary of  Agriculture and Secretary of Trade and Industry, as heads of the implementing agency, are authorized to deputize and enlist the assistance of any government official or agency in carrying out the provisions of the Price Act.

IN VIEW OF THE FOREGOING, this Joint Department Administrative Order (JDAO) is hereby prescribed for the compliance of all concerned.

SECTION 1. In all administrative cases filed in violation of the Price Act which involve basic necessities and prime commodities under the jurisdiction of the Department of Agriculture, the formal charge shall be filed by the office, agency or authorized representative of the Department of Agriculture in the appropriate docketing unit of the Regional Office, Provincial or Field office, Area Office, or other appropriate office or agency of the Department of Trade and Industry, as the case may be.

The Department of Agriculture, through its duly authorized representatives shall have jurisdiction to institute formal charges over violations of the Price Act involving the following commodities:
Basic Necessities:
- Rice
- Corn
- Cooking oil
- Fresh, dried fish and other marine products
- Fresh eggs
- Fresh pork, beef and poultry meat
- Fresh milk
- Fresh vegetables
- Root crops
- Sugar
Prime Commodities
- Fresh fruits
- Dried Pork
- Dried Beef and Poultry meat
- Fresh dairy products  not falling under basic necessities
- Onions, garlic
- Fertilizer (chemical and organic), pesticides, herbicides     
- Poultry, swine and cattle feeds
- Veterinary products for poultry, swine and cattle

SECTION 2.
Administrative actions filed by DA involving violations of the Price Act shall proceed in accordance with DTI Department Administrative Order No. 7, series of
2006.

SECTION 3. All hearing officers of the DTI are deputized to take cognizance of the administrative cases filed by the authorized representative of the DA involving violations of the Price Act.

This Order shall take effect immediately.
