RESOLUTION NO. R-852, AMENDING THE PROCEDURAL GUIDELINES ON THE ENFORCEMENT AND MONITORING OF COMPLIANCE TO SECTION 18 OF R.A. 7279



Attached herewith is HLURB Board Resolution No. R-852, Series of 2010, Amending the Procedural Guidelines on the Enforcement and Monitoring of Compliance to Section 18 of R.A. 7279, which was approved by the Board on 15 March 2010.

The above was published in The Philippine Daily Inquirer on 17 June 2010, and, in accordance with the provisions of law, will take effect fifteen (15) days from its date of publication, on 02 July 2010.

Amending the Procedural Guidelines on the Enforcement and Monitoring of Compliance to Section 18 of RA 7279


WHEREAS, Section 18 of RA 7279 requires developer of subdivision projects to develop a socialized housing project equivalent to twenty percent of its total project cost or area;

WHEREAS, Board Resolution No. 587, series of 1996 provides the Guidelines on the Enforcement and Monitoring of Compliance to Section 18 of RA 7279;

WHEREAS, there is a need to ensure that housing units covered by said socialized housing projects maintain their character as such;

WHEREFORE, BE IT RESOLVED, as it is hereby resolved that the guidelines on the enforcement and monitoring of compliance to Section 18 of RA 7279 at the Processing and Issuance of License to Sell (LS) for Main Projects (Annex B) be amended to include the following:

6 Processor/Evaluator 1. Receives and evaluates documents
 2. Determines compliance to Section 18 of RA 7279
   
 

a. If without compliance project, requires applicant to submit proof of compliance

   
 b. If with compliance project, requires applicant to submit original copy of Development Permit (DP) a n d d u l y annotated LS and determines location:
  

i. In case both projects are in the same region, applicant submits DP of compliance project issued by LGU and the application for CR/LS for its main and compliance project for simultaneous processing

   
  

ii. In case the compliance is located adjacent/ contiguous to the main project, include as one of the conditions in the LS of main project the annotation of the block and lot numbers of compliance project and the annotation of such compliance and its selling price at the back of the title of the lots covered by the socialized housing

   
  

iii. In case compliance is in another region, applicant submits duly annotated CR/LS of compliance project as requirement for processing of CR/LS for main project.

   
 

3. Annotates on LS and stamps on the original DP of main project, the project name, location and area of compliance project.

   
 

4. Recommends issuance of LS for the main project and separate LS for compliance project through the Head, Technical Section.
