RESOLUTION NO. R-860, APPROVING THE INCLUSION OF LEISURE FARMS IN THE COVERAGE OF THE REVISED IMPLEMENTING RULES AND REGULATIONS OF P.D. 957



Quoted hereunder is HLURB Board Resolution No. R-860, Series of 2010, Approving the Inclusion of Leisure Farms in the Coverage of the Revised Implementing Rules and Regulations of P.D. 957, which was approved by the Board on 24 May 2010:

WHEREAS, leisure farm is a land used for agriculture-related tourism or recreation and it is also an agriculture-theme park which incorporates residential resort features;

WHEREAS, it is also a place for hobby farmers and their families to spend their weekends enjoying the beauty of surroundings and the beauty of farm life;

WHEREAS, realities and observations showed that leisure farms were developed with facilities and amenities of regular subdivisions, such as 24- hour security, concrete roads, electrical power supply, deep well and water distribution system, underground drainage system and sewerage, multipurpose hall, etc.;

WHEREAS, based on the records submitted to the Board by some developers of leisure farms, it appears that the elements of a subdivision project are present in this type of development, such as, it is a registered parcel of land, partitioned into individual lots and offered to the public for sale;

WHEREAS, for uniformity and consistency in the implementation of policies of the Board, there is need to clarify the rules that will govern such type of development to avoid circumvention of the law and rules on regular subdivisions;

WHEREAS, pursuant to Article IV Section 5c of Executive Order No. 648 the Housing and Land Use Regulatory Board is mandated to issue Rules and Regulations on land use policies and human settlements to implement PD 957 and other related laws;

WHEREFORE, RESOLVED, as it is hereby RESOLVED that the Board APPROVED the inclusion of leisure farms in the coverage of the Revised Implementing Rules and Regulations for PD 957.
