BOARD OF CHEMISTRY
RESOLUTION NO. 04



SECTION 1. Practice of Chemistry — Pertinent to the definitions of Chemistry and the Scope of Chemistry in Article 1, Section 1 of R.A. 754, the practice of Chemistry shall include, but not necessarily be limited to, the following:

1. Synthesis or preparation of products involving the use of chemical, physico-chemical, biochemical, or microbiological changes;

2. Assay or any other analytical work involving chemicals, minerals, forest products, biological materials, soils, feeds, fuels, foods, beverages, chemical preparations, chemical products, cosmetics, toiletries, and other synthetic and naturally occurring substances;

3. Sale, distribution, and repacking of chemicals, chemical apparatus and equipment: Provided, that in the case of chemical apparatus and equipment, it shall be sufficient if there is a chemist who personally supervises the work;

4. Industrial chemical research and development work, consultancy, evaluation and project studies on problems related to change or prevention of change of matter, or to chemical, physico-chemical, bio-chemical, or microbiological induced processes, or to the use of chemicals in products formulations;

5. Management and direction of chemical quality control laboratories, and chemical quality control or assurance, procedures and practices;

6. Management and direction of chemical laboratories, including verification, classification, assay and certification of products, process standards or specifications;

7. Supervision of chemical technicians.

SECTION 2. Practical Experience in Chemistry — No person shall gain "practical experience in chemistry" in Article 2, Section 13 of R.A. 754 unless the following conditions are satisfied:

1. Practical experience is equivalent to training in chemistry under the direct guidance of a Registered Chemist.  A Registered Chemist can train a maximum of five (5) persons at a time;

2. Experience should involve all the basic branches of chemistry, namely: physical, organic, inorganic, and analytical chemistry;

3. Person gaining experience in chemistry must not be employed as a chemist while under going training;

4. Proficiency, number of years of training, nature of non-monetary compensation, if any, during the training period shall be certified in a sworn statement by the Registered Chemist who provided the training.

SECTION 3. Further to Section 24 of R.A. 754, practice of chemistry by a person who has passed the corresponding Board examination for the practice of a profession already regulated before the passage of R.A. 754 is allowed under the following conditions:

1. Person must be registered in his profession and possess a valid license for that profession.

2. The employment, main source of livelihood or service rendered must be in his profession and not the practice of chemistry as defined by this resolution, otherwise such will be equivalent to the illegal practice of the chemistry profession and subject to the penal provisions of R.A. 754.

SECTION 4. All Registered Chemists are required to indicate their registry number and the number of their current valid license in any written report or correspondence that they sign or submit in the practice of their profession.

Any document involving professional work without the signature of the Registered Chemist and the registry and license numbers described above shall not be valid for purposes of legal record or evidence, or to satisfy any requirement of a government office.

SECTION 5. All chemical laboratories should indicate in their letterhead their laboratory registration number in reporting all professional work provided by the laboratory, otherwise such work shall not be valid for purposes of legal record or evidence, or to satisfy any requirement of a government office.

SECTION 6. After approval hereof by the Commission, the effectivity of this Resolution shall be after fifteen (15) days following the completion of the publication thereof in the Official Gazette or newspaper of general circulation.
