CORRECTED COPY OF HLURB ADMINISTRATIVE ORDER NO. 02, DATED 02 FEBRUARY 2009 ANENT HLURB BOARD RESOLUTION NO. R-830, SERIES OF 2008, ENTITLED MINIMUM LEVEL OF DEVELOPMENT REQUIREMENT IN THE ISSUANCE OF LICENSE TO SELL FOR SUBDIVISION AND CONDOMINIUM PROJECTS



Attached herewith is the corrected copy of the above subject HLURB Administrative Order No. 02 dated 02 February 2009 anent HLURB Board Resolution No. R-830, Series of 2008 which was erroneously referred to in said Administrative Order as “Declaring Habitat for Humanity Philippines Projects as Projects not Covered by the License to Sell of HLURB” instead of “Minimum Level of Development Requirement in the Issuance of License to Sell for Subdivision and Condominium Projects” which is its correct title.

Accordingly, disregard the previously issued administrative order on this matter. For your information and guidance. Adopted: 06 Feb. 2009

Resolution No. R-830, s. 2008, Minimum Level of Development Requirement in the Issuance of License to Sell for Subdivision and Condominium Projects



Quoted hereunder is HLURB Board Resolution No. R-830, Series of 2008, Minimum Level of Development Requirement in the Issuance of License to Sell for Subdivision and Condominium Projects, which was approved by the Board on 28 November 2008:
WHEREAS, under Section 5 of PD 957, an owner or dealer of a registered subdivision or condominium project is required to secure a license to sell before it can be allowed to sell;

WHEREAS, there is a need to ensure that the owner/developer of a proposed subdivision and condominium project shows firm commitment to proceed with the development of such project;

WHEREFORE, RESOLVED, as it is hereby resolved that the following minimum level of development be required before the issuance of license to sell for subdivision and condominium projects:
 
- For subdivision projects – land clearing and grubbing, road tracing, earthworks, sub-base and base preparation activities, and entrance gate if included in the brochure, advertisement or development plan.

- For condominium projects – civil and structural works of foundation to include excavation, pile driving, concreting, steel reinforcement and formworks.

APPROVED, this 28th day of November 2008 at Pasay City.
The above was published in the Philippine Daily Inquirer on 01 February 2009, and, in accordance with the provisions of law, shall take effect fifteen (15) days from its date of publication, on 16 February 2009.
