[ MMDA REGULATION NO. 11-001, January 25, 2011 ]

RESERVING THE TWO RIGHTMOST LANES ALONG EACH SIDE OF COMMONWEALTH AVENUE AS DEDICATED PUBLIC UTILITY BUS, PUBLIC UTILITY JEEPNEY AND MOTORCYCLE LANES



WHEREAS, MMC Ordinance No. 03, Series of 1989, as amended by MMA Ordinance No. 5, Series of 1990, designates and regulates the use of BUS and PUJ Lanes in major thoroughfares of Metro Manila;

WHEREAS, there is an alarming increase in the number of traffic accidents taking place along Commonwealth Avenue in Quezon City, resulting in the tragic loss of life, limb and property;

WHEREAS, it has been observed that a large portion of the accidents involved public utility buses (PUBs), public utility jeepneys (PUJs) and motorcycles (MCs);

WHEREAS, concerned citizens from both the public and private sectors have strongly urged relevant governmental agencies to adopt measures that would eradicate incidences of reckless and unlawful driving along Commonwealth Avenue;

WHEREAS, the Metro Manila Council after due deliberation and in session assembled, agreed to reserve special lanes along Commonwealth Avenue for public utility vehicles and motorcycles in accordance with the mandate set forth in MMC Ordinance No. 3, Series of 1989;

NOW, THEREFORE, be it resolved as it is hereby resolved, by the Metro Manila Council acting through its Chairman, pursuant to Section 6 of RA 7924 and other pertinent laws, that:

Section 1. Designation of PUB, PUJ and Motorcycles Lanes along Commonwealth Avenue. – The two rightmost lanes along both sides of Commonwealth Avenue in Quezon City, are hereby reserved for dedicated use, one lane each by: (a) Public Utility Buses, and (b) Public Utility Jeepneys and Motorcycles.

The said lanes shall be identifiable by appropriate markings on the road pavement, supplemented by gantry signs and/or regulatory signs on sidewalks along the lanes at suitable locations after an intersection or junction and at other duly designated places along Commonwealth Avenue.

Section 2. Parking on a Bus, PUJ or Motorcycle Lane. – Parking is not permitted on Bus, PUJ and Motorcycles lanes except by emergency vehicles on official duty. Moreover, no parking for all types of vehicles along sidewalks and all portions of Com- monwealth Avenue shall be enforced.

Section 3. Right Turning Movements. – A driver intending to make a right turn shall give adequate advance warning, signaling his intention to enter the BUS, PUJ and Motorcycle lanes. He shall then keep his vehicle to the curbside lane making his turn. Adequate advance warning shall mean:

  1. The driver shall turn on his signal light and merge on the right lane indicating his intention to turn right 100 meters prior to the intersection if the road has no yellow broken lines; or

  2. If the road has yellow broken lines, the driver shall turn on his signal light and merge on the right lane upon reaching the yellow broken lines.

Section 4. Speed Limit – The speed limit for all types of vehicles, including public utility buses, public utility jeepneys and motorcycles traversing Commonwealth Avenue shall be a maximum of sixty kilometers per hour (60 kph).

Section 5. Penalty. – The driver of any vehicle who shall violate this Regulation shall be meted with fines and penalties in the amount of One Thousand Two Hundred Pesos (Php1,200.00), without prejudice to his liability under other existing traffic laws, resolutions, ordinances, rules and regulations.

Section 6. Repealing or Amending Clause. – All regulations, resolutions and issu- ances or any part thereof that are inconsistent herewith are hereby repealed, superseded or modified accordingly.

Section 7. Effectivity. – This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation.
