NATIONAL TOBACCO ADMINISTRATION
[ NTA MEMORANDUM CIRCULAR NO. 001, S. 2011, February 08, 2011 ]
FURTHER AMENDING SECTION 12 (B) OF ARTICLE V OF THE RULES AND REGULATION GOVERNING THE EXPORTATION AND IMPORTATION OF LEAF TOBACCO AND TOBACCO PRODUCTS, AS AMENDED BY MEMORANDUM CIRCULAR NOS. 002 AND 002-A, SERIES OF 2010
WHEREAS, there are tobacco manufacturers who are licensed by the NTA to import leaf tobacco for manufacturing/blending purposes but are not buying locally grown leaf tobacco;
WHEREAS, the NTA encourages all local tobacco manufacturers to buy locally grown leaf tobacco before any importation is made;
WHEREAS, the NTA likewise encourages increase in the local production of leaf tobacco, to add income for the tobacco producers/farmers; and
WHEREAS, after a series of consultative meetings/consultations with the stakeholders of the tobacco industry, it was agreed upon to further amend the fees imposed in the importation of leaf tobacco by local manufacturers who are not buying locally grown leaf tobacco.
NOW, THEREFORE, for and in consideration of the foregoing premises and by virtue of the powers conferred into the NTA, Sections 12 (B), Article V of the Export/Import Rules and Regulations, is hereby further amended for the information and guidance of all concerned, to wit:

WHEREAS, the NTA encourages all local tobacco manufacturers to buy locally grown leaf tobacco before any importation is made;
WHEREAS, the NTA likewise encourages increase in the local production of leaf tobacco, to add income for the tobacco producers/farmers; and

Section 1. Section 12 (B), Article V of the Export/Import Rules and Regulations is hereby further amended to read, as follows:
“Section 12. Monitoring, Regulation, Supervision and/or Evaluation of the Commodity. – x x x B.
Unmanufactured and wholly and/or partially processed leaf tobacco
(in conventional cargo, packed in bobbins boxes, bags, sacks, crates, etc.)x x x 4. Legitimate Local Tobacco Products Manufacturers/ Processors who are not buying locally
Section 2. Effectivity and Miscellaneous Provision. This Memorandum Circular shall take effect fifteen (15) days after its publication in a newspaper of general circulation and filing with the Office of the National Administrative Register (ONAR).
