(DENR) GOLF COURSE CONSTRUCTION AND DEVELOPMENT COMMITTEE RESOLUTION NO. 4-2002 AMENDING GCCDC RESOLUTION NO. 01-97 TO STREAMLINE THE REQUIREMENTS FOR PROPOSED GOLF COURSE PROJECTS



WHEREAS, Executive Order No. 342 issued on 06 June 1996 provides under Item 3.a, “The Committee shall have the power to adopt and promulgate standards for the construction, development, and operation of golf courses taking into consideration, among others, the protection of the environment, the conservation of natural resources, and optimum land utilization.”

WHEREAS, the Committee promulgated GCCDC Resolution No. 01-97, “Prescribing the Guidelines in Granting of Favorable Recommendation for the Issuance of Environmental Compliance Certificate (ECC) for the Construction, Development and Operation of Golf Courses.”

WHEREAS, the Committee recognized the need to streamline the procedures contained in GCCDC Resolution No. 01-97 to make the Committee more efficient in performing its functions.

WHEREFORE, The Committee hereby adopts the following required documents for the Initial Project Description (IPD), thereby amending Item 6, Section 3 of GCCDC Resolution No. 01-97:

1.         Certification issued by the Secretary of the Department of the Environment and Natural Resources (DENR) or his authorized representative - that the proposed project area is not within the National Integrated Protected Areas System (NIPAS), Environmentally Critical Areas, or other areas where development is prescribed by a President Proclamation;

2.         Certificate of Viability of Agricultural Lands for conversion of the proposed project area for golf course purposes issued by the Secretary of the Department of Agriculture (DA) or his authorized representative; and

3.         Order of Conversion from agricultural land to golf course/recreational purposes OR Certification that the proposed project area is not covered by the Comprehensive Agrarian Reform Law (CARL) issued by the Secretary of the Department of Agrarian Reform (DAR) or his authorized representative.

Effectivity

These rules shall be effective fifteen (15) days after publication in at least one (1) newspaper of general circulation, and shall govern future applications for the Notice to Conduct the Environmental Impact Study (NTC-EIS).

Applications for the NTC-EIS pending with the Committee shall be re-evaluated considering the above-listed requirements.
