DIRECTING THE IMPLEMENTATION OF THE "3% WORKERS' SHARE" UNDER RA 809 IN SONEDCO MILL DISTRICT AND THE CORRESPONDING ADJUSTMENT OF THE SOCIAL AMELIORATION FUND (SAF) LIEN COLLECTION FROM P10.00 TO P5.00 PER PICUL OF SUGAR PRODUCED BY SONEDCO SUGAR PLANTERS AS PROVIDED FOR UNDER RA 6982 BEGINNING CROP YEAR 2002-2003



On recommendation of the Sugar Tripartite Council per its Resolution No. 3, series of 2002 and pending issuance of guidelines institutionalizing good, reasonable and acceptance practices and procedures in the implementation of Section 9 of RA 809, otherwise known as the Sugar Act of 1952, the following shall be observed:

SECTION 1.       Implementation of RA 809. — The 3% worker's share under RA 809 shall be implemented in SONEDCO mill district in view of the increase in planter's sharing participation granted by the SONEDCO sugar mill to the district planters beginning CY 2002-2003.

SECTION 2.       Adjustment of SAF Lien Collection. — Beginning CY 2002–2003, SAF lien collection in SONEDCO mill district shall be adjusted from P10.00 to P5.00 per picul of sugar produced in the particular case of planter milling their canes with the SONEDCO sugar mill, so it would remain competitive with other mill district implementing RA 809.

SECTION 3.       Quedanning of Worker's Share. — The 3% worker's share in the total sugar production, representing 60% of the increase in participation granted by the mill to planters a provided under RA 809, shall be quedanned in the name of the Secretary of Labor and Employment, as trustee of the fund, for distribution to the covered sugar farm workers of SONEDCO mill district.

SECTION 4.       Sale of the Quedanned Worker's Share. — The Department of Labor and Employment - Regional Office (DOLE-RO) having jurisdiction of the implementation shall oversee the sale of the quedanned worker's share through public bidding in accordance with prescribed government accounting and auditing rules, regulations and procedures.

SECTION 5.       Management of Proceeds. — The proceeds of the sale of the quedanned workers' share shall be immediately deposited in an interest-bearing account by the DOLE-RO in a government depository bank under the name of the Secretary of Labor and Employment as trustee of the fund.

SECTION 6.       Monitoring of the Worker's Share. — The mill shall provide the DOLE-RO with a monthly report of quedanned worker's share.

SECTION 7.       Effectivity. — This Department Order shall take effect upon the start of sugar crop year 2002-2003.
