[ PRC RESOLUTION NO. 2010-560, May 07, 2010 ]

REVISED GUIDELINES ON THE RELEASE OF PROFESSIONAL REGULATORY BOARD CHAIRMEN/VICE-CHAIRMEN/MEMBERS AND PRC PERSONNEL FROM THE CONFIDENTIAL PRINTING ROOM DURING BOARD LICENSURE EXAMINATIONS



WHEREAS, pursuant to Sec. 7 (d) of R.A. No. 8961 called the “PRC Modernization Act of 2000”, the Commission issued Res. 2008-422, Series of 2008 entitled “Amended Guidelines in the Release of Professional Regulatory Board Members and PRC Personnel from the Confidential Printing Room and the Release of Copies of Test Questionnaires to the Members of the Professional Regulatory Boards”;

WHEREAS, there were incidents in the past that encouraged the Commission to promulgate stricter rules and regulations, particularly inside the Confidential Printing Room in order to erase doubts of collusion or leaking of test questions and answers to examinees in Board licensure examinations;

WHEREAS, safety measures are already in place to curve and to prevent the occurrence of similar incidents in the future thereby preserving and ensuring the integrity of all Board licensure examinations;

WHEREAS, with such stricter and safety measures, there is a need to revise Res. No. 2008-422, Series of 2008 by reverting to the rule that after one (1) hour from the start of the only or last examination subject of the day the Professional Regulatory Board Chairman/Vice-Chairman/Members and the PRC Personnel assigned in the Confidential Printing Room in the Central Office and Regional Offices shall be released/dismissed;

WHEREFORE, the Commission resolves, as it is hereby resolved, to supersede Res. No. 2008-422, Series of 2008 with the herein Resolution and to state therein the following revised guidelines:

1. For examinations with two or three (3) subjects for the day, the Professional Regulatory Board Chairman/Vice-Chairman/Member who owns the subject in the morning and the one who owns the subsequent subject/s for the day shall enter the Confidential Printing Room together with the PRC Personnel assigned therein.

2. For examinations with only one (1) subject or with two (2) or three (3) subjects for the day, the Professional Regulatory Board Chairman/Vice-Chairman/Members and the PRC Confidential Printing Room Personnel shall be released after one (1) hour from the start of the only subject or the last subject for the day.

3. The Confidential Printing Room Supervisor shall give copies of the test questionnaires (one copy each of Set A and Set B) to the Head of the Rating Division in a sealed envelope at the end of every examination day.

4. The sealed envelope containing the copies of the test questionnaires shall be released to the Professional Regulatory Board Chairman/Vice-Chairman/Member (who owns the subject) by the Head of the Rating Division on the following day after his/her subject is given.

5. All Professional Regulatory Board Chairmen/Vice-Chairmen/Members are prohibited from answering the test questions while inside the Confidential Printing Room.

6. Anyone who violates this Resolution shall be subjected to disciplinary action under the Civil Service law and/or rules and regulations thereof, R.A. No. 8981, and/or its implementing rules and regulations.

This Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or in newspaper of general circulation in the Philippines.

Let a copy of this Resolution be furnished the U.P. Law Center.

The Chairman of the Commission shall issue an Office Order to all concerned for the strict implementation of this Resolution.
