[ SRA SUGAR ORDER NO. 8 s. 1992-1993, February 18, 1993 ]

PROVIDING FOR "C" OR RESERVE SUGAR AND FOR OTHER PURPOSES



WHEREAS, Section 2 of SRA Sugar Order No. 1, Series of 1992-1993, dated September 3, 1992, provides that the Sugar Regulatory Administration shall undertake periodic assessments of the 1992-1993 sugar production and, on the basis of such assessments, it shall adjust from time to time the percentage distribution of the different classes of sugar;

WHEREAS, the price of "B" or Domestic sugar has dropped to an alarmingly low level that it seriously imperils the economic viability of the sugar industry;

WHEREAS, Section 2 (B) of Executive Order No. 18 mandates the Sugar Regulatory Administration "to establish and maintain such balanced relation between production and requirement of sugar and such marketing conditions as will ensure stabilized prices at a level reasonably profitable to the producers and fair to consumers";

WHEREAS, after consultations with all sectors concerned, it has been agreed that the classification and allocation of sugar under SRA Sugar Order No. 1, Series of 1992-1993, need to be reviewed and revised in order to address the aforesaid situation conformably with the aforestated mandate of Executive Order No. 18;

NOW, THEREFORE, pursuant to the powers vested in the Sugar Regulatory Administration, it is hereby ordered that:

SECTION 1.       (a) The classification and percentage allocations of sugar under SRA Sugar Order No. 1, Series of 1992-1993, are hereby amended and revised in the manner as hereinafter provided.

(b) There is hereby established and provided a class “C” or Reserve sugar.  The said class “C” or Reserve sugar shall subsequently be reclassified as “B” or Domestic sugar, to the exclusion of any other class of sugar, and shall be released to the domestic market wholly or in staggered partial releases, whenever the supply-demand situation warrants in the furtherance of the aforestated mandate of Executive Order No. 18. In case of staggered partial releases, the said releases shall be effected on a “first-in, first-out” basis.

(c)     All sugar produced beginning February 22, 1993 shall be quedanned by the mill companies, as implementors of this sugar order, in the following classification and percentage allocation:

"A" or Export Sugar

"B" or Domestic sugar
-
44.0%
"C" or Reserve sugar
-
40.5%
"D" or World Market sugar
-
8.0%

SECTION 2. (a) The mill Companies shall, on a weekly basis, issue consolidated "C" quedan-permits on planters’ share in the name of their respective planters associations/cooperatives, with an attached listing of the individual planters and their respective shares.

In the case of non-affiliated planters, the quedanning of their "C" sugar shall, at their option, be joined with any planters association/cooperative in the mill district which they will designate or with the mill company.

(b)     In the case of financed planters, the mill companies may segregate said planters by financing bank/institution and issued separate but still consolidated "C" quedan-permits in the name of the planters association/cooperative as provided in this section.

Similarly, the "C" sugar production of non-financed or “free” planters may be issued separate but still consolidated quedan-permits in the name of the planters association/cooperative as provided in this section.

SECTION 3. The provisions of SRA Sugar Order No. 1, Series of 1992-1993, on consolidated quedanning of "D" or World Market sugar are hereby amended and revised accordingly to conform with the provisions of the preceding section.

SECTION 4. The regular "B" or Domestic Quedan-Permit Form for Crop Year 1992-1993 shall be utilized to quedan the "C" sugar and, for this purpose, the letter "C" in conspicuous size and color shall be stamped at the upper right-hand corner of each of the three portions of the quedan-permit.

SECTION 5. This Sugar Order shall take effect on 22 February 1993.

SECTION 6.       Provisions of sugar orders, circular letters, rules and regulations contrary to or inconsistent with this Sugar Order are hereby revoked, amended or modified accordingly.
