AMENDMENTS TO THE IMPLEMENTING RULES AND REGULATIONS OF THE WITNESS PROTECTION, SECURITY AND BENEFIT ACT (R.A. NO. 6981)



In the interest of the service and pursuant to Section 18 of Republic Act No. 6981, otherwise known as the Witness Protection, Security and Benefit Act, the following provisions of the Implementing Rules and Regulations, hereinafter referred to as IRR-WSPB, are hereby amended as follows:

"TITLE II
Program Implementors

SECTION 1.A — The Undersecretary in-charge of the National Prosecution Service (NPS) shall be responsible for the implementation of the Program.  He shall be assisted by a Program Director, who shall, upon the recommendation of the Under-secretary in-charge, be designated by the Secretary.

B. Functions of the Program Implementors

a) The Undersecretary in-charge shall, upon the recommendation of the Program Director, recommend necessary measures for the formulation, administration, control, super-vision and effective implementation of the Program;

b) Examine applicants, sworn statements, relevant facts, determine compliance with the requirements of the Act and the implementing rules and regulations of the Program;

c) Recommend to the Secretary the termination of the enjoyment of the rights and benefits accorded the Witness in case of a substantial breach of the Memorandum of Agreement;

d) Coordinate the functions and activities of the other government agencies involved in the implementation of the Program; and

e) Perform such other functions and duties as may be provided by law or as the Secretary may from time to time deem necessary to effectively implement policies and to carry out the objectives of the Program."

All references to the "Committee" and/or "Chairman of the Committee" shall henceforth refer to the "program implementors" and/or "Undersecretary in-charge of the National Prosecution Service."

These amendments shall become effective after fifteen (15) days following their publication in two (2) newspaper of general circulation.
