[ PHILRACOM RESOLUTION NO. 02-10, S. OF 2010, February 10, 2010 ]

RULES AND REGULATIONS ON HORSE RACING RE: PENALTY FOR LACK OF INTEREST



WHEREAS, the Philippine Racing Commission (PHILRACOM) has the power among others, to issue, suspend, or revoke permits and licenses and to impose or collect fees for the issuance of such licenses or permits to persons required to obtain the same;

WHEREAS, P.R. 14 of the PHILRACOM Rules and Regulations on Horse Racing provides:

PR 14. Lack of Interest or Considered not to be Competitive - That the positioning of his mount was not to the betterment of his mount’s chance throughout the race:

WHEREAS, the said offense carries with it the penalty of three (3) to eight (8) weeks suspension as provided for under P.R.  87 (c);

WHEREAS, due to the seriousness and gravity of the effect occasioned by the commission of the said offense, there is a need to raise the maximum penalty imposed for the said infraction to six (6) months or a period of one hundred forty four (144) racing days;

WHEREAS, the PHILRACOM has the discretion to impose and temper the range of imposable penalties from one (1) month to six (6) months depending on the circumstances attendant to the case for its review;

NOW THEREFORE, it is hereby resolved by the Commissioners present that the penalty for LACK OF INTEREST provided for under P.R. 14 be amended to increase the penalty from three (3) to eight weeks to one (1) month to six (6) months which the PHILRACOM may impose and temper depending on the attendant circumstances of the case for its review.

RESOLVED FURTHER, that a signed true copy of this resolution be published in the Kopya and the UP Law Center.
