[ SRA SUGAR ORDER NO. 9, SERIES OF 2009-2010, February 11, 2010 ]

VERIFICATION OF “A” OR U.S. MARKET SUGAR QUEDANS FOR CROP YEAR 2009-2010



WHEREAS, Sugar Order No. 1, Series of 2009-2010, as amended, provided for the classification of “A” or U.S. Quota sugar on production during Crop Year 2009-2010;

WHEREAS, Sugar Order No. 2, Series of 2009-2010 provided the guidelines for filling up the U.S. Quota for Quota Year 2009-2010;

WHEREAS, published reports on the drop in world sugar production strongly signals a possible increase in the U.S. Quota for the Philippines, and the announcement of such quota increase may be made early in April 2010;

WHEREAS, preparations for such additional quota must be in place even prior to the announcement - to ensure the orderly processing of documents, as well as the eventual shipment of the sugar to comply with deadlines of the USDA for the sugar to arrive in U.S. ports;

WHEREAS, such preparation will require the determination of the volume of actual physical sugar ready for shipment, or of the sugar that traders/exporters are willing to ship, through verification as stipulated in the above-mentioned Sugar Order No. 2, Series of 2009-2010;

NOW THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), the following is hereby ordered:

SECTION 1. Coverage of Verification. “A” sugar quedan-permits issued for the current  crop year and reinstated “A” sugar quedan-permits of previous crop years are eligible for verification under this sugar order.

SECTION 2. Deadline of Verification
a. “A” sugar quedan-permits issued from the start of crop year 2009-2010 until weekending January 31, 2010 shall be submitted for verification on or before March 8, 2010. Any “A” sugar quedan-permit not verified by March 8, 2010 shall be declared homeless and non-negotiable/non-marketable, and the same cannot be withdrawn from the mill.

b. Reinstated homeless “A” sugar quedan-permits of previous crop years, subject to the provisions of Sugar Order No. 3, Series of 2009-2010, shall likewise be submitted for verification on or before March 8, 2010. Failure to submit for verification such reinstated quedan-permits shall render the same as homeless.
SECTION 3.  Provisions of Sugar Orders, Circular Letters, rules and regulations contrary to or inconsistent with this Sugar Order is hereby revised, modified or revoked.

SECTION 4. This Order shall take effect immediately.
