[ ERC RESOLUTION NO. 01, S. 2012, January 09, 2012 ]

A RESOLUTION ADOPTING CERTAIN GUIDELINES FOR THE IMPLEMENTATION BY THE DISTRIBUTION UTILITIES OF THE UNIFORM REPORTORIAL REQUIREMENTS STARTING JANUARY 2012



WHEREAS, on July 13, 2009, the Energy Regulatory Commission (ERC) issued Resolution No. 17, Series of 2009 adopting the Uniform Reportorial Requirements (URR) to be used by all the Distribution Utilities (DUs) in lieu of ERC DU-M01, ERC DU-M02 and reportorial requirements imposed in various automatic adjustment mechanisms;

WHEREAS, on December 16, 2009, the ERC issued Resolution No. 24, Series of 2009 suspending until further notice the implementation of the URR pending resolution of issues related thereto;

WHEREAS, on September 26, 2011, the ERC issued Resolution No. 24, Series of 2011, approving and adopting the revised URR excel model to be implemented starting January 2012 and the conduct of information dissemination on the use of the URR model to ensure common understanding on the filling-out of the model and its strict and timely submission.

WHEREAS, on various dates, the ERC conducted a series of regional seminar/workshops on the URR model to orient the DUs on its use and the filling-out of information on the applicable worksheets;

NOW THEREFORE, the ERC hereby RESOLVES, as it is hereby RESOLVED:

  1. To transmit to each DU a customized URR model with its unique password for its use in the monthly computation of various monthly pass-through rates as mandated under Resolution No. 16, Series of 2009, to be submitted to the ERC in accordance with the requirements as set forth in Resolution No. 24, Series of 2011; and

  2. To direct the DUs to strictly comply with the following procedures in the filling-out and submission of the URR model:

  • Only the yellow colored worksheets shall be used by the DUs in filling out the required input data on the yellow colored cells provided therein;
  • The file name convention of the URR model shall be followed and used by the DUs in their monthly submissions;
  • No row or column in any of the worksheets in the URR model shall be inserted or deleted by the DUs;
  • Any of the yellow colored input cells that are not applicable shall be left blank by the DUs;
  • Previous submission of the URR model shall not be altered or changed by the DUs;
  • The password which is unique to each DU shall not be changed, altered or cracked to protect the various formulae in the URR worksheets; and
  • Only the appropriate cells for transmission charges shall be filled out by the DUs to be consistent with the rate design of the Rules for Setting the Electric Cooperatives’ Wheeling Rates (RSEC-WR) and Rules Setting the Distribution Wheeling Rates (RDWR)

Failure on the part of the DUs to comply with the above procedures shall be subject to sanctions by the ERC.

This Resolution shall take effect immediately.

Let copies of this Resolution be published in a newspaper of general circulation in the Philippines, be posted in the ERC website and filed with the University of the Philippines Law Center – Office of the National Administrative Register (UPLC-ONAR).
