EXTENSION OF VALIDITY



The Board has been receiving Motions to Accept Late Filing of Applications for Extension of Validity involving one to two units of public utility jeepneys (PUJ). The Board has received reports also that these jeepneys continue to operate despite the lapse of their franchise considering that, more often than not, these jeeneys are the main, if not the only, source of income of the operator - owners.

Furthermore, the Board is also cognizant of the fact that a lot of public utility vehicle operators were adversely affected by the financial crisis that hit the country in 1997.

After consultation with various jeepney associations, and in view of the foregoing premises, the Board hereby allows the acceptance and processing of Applications for Extension of Validity whose franchises expired as of January 1, 1997 or later provided the applications shall cover not more than two (2) jeepney units per franchise, and that during the hearing, it is proven that the units to be used are in the name of the operator-applicant, the units have passed the motor vehicle inspection of the Land Transportation Office and a certification to this effect has been issued and submitted to the Board, the appropriate fines and penalties have been paid, and subject further to the existing procedures and requirements of the Board for the resolution of applications of this nature.

All issuances or parts thereof, which are inconsistent herewith are hereby modified accordingly and/or superseded/revoked.

This Memorandum Circular shall take effect fifteen (15) days after filing of three (3) copies hereof with the U. P. Law Center, in accordance with Presidential Memorandum Circular No. 11 dated October 9, 1992, and shall continue to be effective for a period of ninety (90) days from date of effectivity.
