ACCEPTANCE AND PROCESSING OF APPLICATION FOR ISSUANCE OF CERTIFICATE OF PUBLIC CONVENIENCE (CPC) UNDER RA 9295



To ensure the uninterrupted service in the domestic trade, notice is hereby given that applications for issuance of company/entity CPC under RA 9295 shall be accepted and acted upon pending the issuance of the rules on the compliance with the submission of the Compulsory Cargo Insurance Coverage under Sec. 1.1.2, Rule IX of the IRR of RA 9295.

Applications for company/entity CPC shall likewise be accepted and acted upon with the submission of the Passenger Insurance Coverage in the amount of P 100,000.00 per passenger pending the finalization of the rules allowing consortium of insurance companies to cover passengers at P 200,000.00 each, pursuant to Sec. 1.1.1, Rule IX of the IRR of RA 9295, and the Memorandum of Agreement currently under negotiation with the Insurance Commission.

In both cases, an Oath of Undertaking shall be required from the applicant company/entity to the effect that the required compulsory cargo insurance and/or passenger insurance in the amount of P 200,000.00, as applicable, shall be submitted/complied with in accordance with the stipulated period in the MC to be issued accordingly. It is understood that Decision/CPC to be issued shall be without prejudice to the submission/compliance with the rules to be promulgated.

Finally, the classification requirement under MC No. 199 for wooden-hulled passenger carrying ships of 150 GT and below is hereby ordered deferred, and applications for company/entity CPC for these ships shall likewise be accepted and processed accordingly. The Decision/CPC to be issued shall be without prejudice to the issuance of the revised rules/guidelines on the classification requirement for passenger-company ships 150 GT and below.
