[ BAI ADMINISTRATIVE ORDER NO. 02, January 15, 2008 ]

HAULING, TRANSPORT, DELIVERY AND DISPOSAL OF CHICKEN DUNG AND ANIMAL MANURE



WHEREAS, there is a danger of spreading diseases namely, Newcastle Disease, Foot and Mouth Disease and other livestock and poultry diseases to other provinces in the country by transporting chicken and animal manure coming from commercial poultry and livestock farms;

WHEREAS, the country has maintained its Avian Influenza - free status, allowing exportation of poultry meat and meat products to other countries;

WHEREAS, there is a need to protect the P160 billion pesos - poultry industry from the spread of dangerous communicable diseases.

NOW, THEREFORE, I, ARTHUR C. YAP, Secretary of the Department of Agriculture, pursuant to Section 18, Chapter 4, Title IV, Book IV of the Administrative Code of 1987, Article 7 of Republic Act No. 7394, otherwise known as the Consumer Act of the Philippines, and the animal quarantine powers vested in me under Sections 1761-1770 of the Revised Administrative Code of 1917, do hereby issue this Order:

SECTION I. General Requirements for Movement and Disposal of Chicken Dung and Animal Manure in Any Point in the Country -

1. All persons or entity transporting chicken dung and animal manure must secure a Handler's and Livestock Transport Carrier's License, issued by the Bureau of Animal Industry- Marketing Development Division (BAI-MDD). No person is allowed to transport manure, unless he has secured the necessary license.

2. All movement or transportation of manure must be accompanied by an approved shipping permit, issued by the Director of Bureau of Animal Industry or his duly authorized representative, Quarantine Officers and deputized Veterinarians.

3. All Quarantine Officers and deputized Veterinarians are authorized to inspect the different farms/establishments and shipments at any reasonable time of the day to monitor reported chicken dung and animal manure for movement to any point in the country.

SECTION II. Biosecurity Measures/Required Practices on the Movement of Chicken Dung and Animal Manure -

1. All chicken dung and animal manure should be dry and placed in sacks prior to transport and should be covered with plastic or nylon canvass.

2. The sacks should be disinfected/fumigated with BAI approved disinfectant/fumigant.

3. The vehicle for shipment of chicken dung and animal manure should be thoroughly cleaned and disinfected.

4. Transporting vehicles must be constructed/equipped to prevent the contents from dropping, sifting, leaking, or otherwise escaping while traveling on public roads.

5. The vehicle for shipment of the chicken dung and animal manure should have not been used for shipment of FMD susceptible animal for at least seven (7) days.

6. Provision for disinfection and sanitation facilities should be made available to employees.

7. Vehicles (including tires and undercarriages) entering and leaving the farm premises after each hauling and delivery of manure should be cleaned and disinfected. Such vehicles are prohibited from visiting other farms.

8. All transport carriers of chicken dung and animal manure should have a knapsack prayers and disinfectant.

9 Transport of chicken dung and animal manure from Luzon to disease free areas i.e. Visayas, Mindanao, Palawan and Masbate is prohibited.

SECTION III. Administrative Sanction - Carriers of chicken dung and animal manure without Handler's and Livestock Transport Carrier's License accosted at the Veterinary Quarantine Check Points shall be turned back/denied entry. A registry of violating persons or entities shall be listed down and posted in the Veterinary Quarantine Checkpoints for information/reference.

The Handler's and Livestock Transport Carrier's License of persons or entity found violating the above mentioned requirements and measures in the transport of chicken dung and animal manure shall be revoked.

SECTION IV. Penalty - Any specific violation of any provision of this Administrative Order shall be penalized in accordance with the applicable penal provisions of Article 19 of the Consumer Act of the Philippines, and Section 2747 of the Revised Administrative Code

SECTION V. Effectivity - This Order shall take effect after fifteen (15) days following its publication in a newspaper of general circulation and the filing of three (3) certified copies thereof with the National Administrative Register of the University of the Philippines Law Center.
