Section 1. Purpose

This Memorandum Circular provides the guidelines and procedures for the uniform implementation of MMDA Regulation No. 96-005, as amended, entitled, “UNIFIED VEHICULAR VOLUME REDUCTION PROGRAM REGULATING THE OPERATION OF CERTAIN MOTOR VEHICLES ON ALL ROADS IN METROPOLITAN MANILA”, section 5 of which provides as follows:

“The MMDA Chairman shall issue necessary guidelines and rules implementing this regulation. As the situation warrants and when extremely necessary, he may grant exemptions on this regulation.”

Section 2. Coverage and Application

The Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, applies to all motor vehicles, both public and private, and prohibits the operations of same in all national, city and municipal roads of Metro Manila from 7:00 a.m. to 7:00 p.m. during corresponding days of the week, except on Saturdays, Sundays and Official Public Holidays, depending on the last digit of the vehicle’s license plate as indicated herein below.

License plates include Vanity License Plates (VLP) and the Optional Motor Vehicle Special Plates (OMVSP) issued by the Land Transportation Office (LTO) and, for the purpose of implementation of the UVVRP, the last numerical digit of the same shall determine the day the vehicle is covered by the UVVRP. Without prejudice to applicable LTO rules on the matter, the last digit of the unexpired and valid conduction stickers issued by the LTO to newly acquired vehicles shall be considered in the implementation of the UVVRP.

Section 3. Window Hours

Notwithstanding the provisions of the immediately preceding section, private vehicles covered by the UVVRP shall be allowed to use the roads within Metropolitan Manila during the window hours from 10:00a.m. to 3:00p.m. However, public utility vehicles shall not be allowed during the window hours.

Section 4. UVVRP Suspension

The UVVRP shall be automatically lifted of suspended upon issuance by the Office of the President of Metro Manila-wide memorandum circulars/directives suspending work and/or announcing non working holidays in view of bad weather, flooding, transport strikes, rallies and other natural and man-made calamities/events.

The Chairman, in cases of extreme urgency and necessity, may likewise suspend the UVVRP.

Section 5. Exemptions

The following are exempted from the UVVRP in accordance with Regulation No. 96-005, as amended:

1. Cargo trucks and other heavy vehicles, whether empty or loaded, as defined in Section 2 of MMC Ordinance No. 78-04, as amended, which shall continue to be covered by MMA Ordinance No. 5, Series of 1994 governing truck ban.
   
   
2. Ambulance, firetrucks, police patrol cars, military vehicles with permanent marking indicating the vehicles as such. Ambulance and firetrucks, which are privately owned and properly marked as such, shall likewise be exempted.
   
   
3. Vehicles commandeered by the government directed by a person in authority or his agent/or by a medical practitioner for military relief or emergency purposes.
   
   
4. Vehicles carrying person/s needing immediate medical attention.
   
   
5. Diplomatic vehicles with diplomatic plates.
   
   
6. Government vehicles with government plates or appropriate LTO stickers with permanent markings expressly showing the name of government agency or office, including those vehicles of members of Congress with officially issued LTO Protocol plates while being utilized in the performance of their functions.
   
   
7. Duly enfranchised school buses, including school buses with provisional authority by the Land Transportation Franchising Regulatory Board (LTFRB), with appropriate LTO stickers and markings. Company buses/shuttle service ferrying employees for free and with appropriate LTO stickers and markings are also exempted.
   
   
8. Official media vehicles with corresponding markings showing name/logo of the media firm and duly registered under the said firm as evidenced by valid registration papers.
   
   Privately owned vehicles being used by media personalities on official duties as attested by the concerned publisher/editor/station manager, are exempted provided that the written authority aforementioned is carried and ready for presentation upon request. A signboard, indicating the media establishment represented, shall likewise be conspicuously displayed on the vehicle.
   
   
9. MMDA accredited tow trucks provided that the accreditation papers must be carried and ready for presentation upon request.
   
   
10. Vehicles delivering perishable goods in commercial quantity. Perishable goods shall include:
    

    
    
    1. fresh vegetables, fruits, and flowers
       
    2. raw meat, fresh seafood
       
    3. ice products (ice, ice cream and the like)
       
    4. baked products with shelf life of 24 hours
       
    5. medicine/vaccine expiring within 24 hours
       
    6. cooked food (catering)

    
    
11. Vehicles used by medical practitioners in an emergency.
    
    
12. Vehicles on a mission to carry relief goods to identified calamity or highly depressed areas
    
    
13. Motorcycles pursuant to MMDA Memorandum Circular No. 96-005B (1998); provided that, motorcycle drivers are complying with the requirements under Republic Act No. 10054 or the “Motorcycle Helmet Act of 2009” and MMDA Resolution No. 07-06, Series of 2007 requiring the permanent use of daylight riding Lights/Headlights while on the road at any time of the day.
    
    
14. DOT accredited tourism vehicles expressly marked as such.

Section 6. One-Day exemptions.

The Chairman may grant one-day exemptions from the UVVRP on a case-to-case basis and as may warranted by circumstances. Requests for such exemptions shall be made at least a day before the date the exemption is being asked.

Section 7. Additional Exemptions

The Chairman of MMDA may grant additional or limit/withdraw exemptions pursuant to existing regulations based on highly exceptional circumstances.

Section 8. Truck ban conduct passes

Pursuant to MMDA Regulation No. 98-006-A, truck ban conduct passes shall be granted to the following on a limited basis:

1. Heavy vehicles delivering petroleum products,
   
2. Heavy vehicles undertaking international messengerial services,
   
3. Heavy vehicles utilized as garbage trucks,
   
4. Emergency heavy vehicles of power and water companies,
   
5. Heavy vehicles being utilized by the government in the construction of flagship projects as identified by the MMDA and subject to the issuance of a valid certification and trip pass by the government authority concerned such as DPWH, DOTC, LGUS, PEA, et al.
   
6. Heavy vehicles carrying perishable goods in commercial quantity.

Section 9. Application for exemptions

The vehicles mentioned in Section 5 (b), (c), (d), (e), (f), (i), (l) and (m) shall be automatically exempted from the UVVRP and need not be applied for exemptions

For regulation, administration and verification purposes, vehicles mentioned in Section 5 (g) [school buses and company shuttle vehicles], (h) [media vehicles], (j) [vehicles for perishable goods], (k) [medical practitioners], (n) [DOT Accredited tourism vehicles], and other vehicles wishing to avail of UVVRP exemptions are required to apply for exemptions.

Owners of the vehicles mentioned in the immediately preceding paragraph shall be required to submit an application letter and supporting documents including, but not limited to, the OR and CR of the vehicles being applied for exemptions, valid identification papers, justification for the application, employment certificate, valid franchise, business permits, accreditation papers and other documents necessary to support the application.

Section 10. Conditions and limitations

Those who will be issued exemptions from the UVVRP shall strictly comply with the conditions stated on the certificates. Violation of any of the conditions stated therein shall warrant immediate cancellation of the exemption.

Any provisions of this Circular notwithstanding, vehicle owners who will utilize the exemption certificates and conduct passes issued pursuant to this Circular shall not be allowed to use any portion of the Epifanio Delos Santos Avenue (EDSA), except for extreme cases of emergency and necessity.

Section 11. Fees

Applicants for exemptions and conduct passes under this Circular shall pay the following filing and processing fees:

 

a) Vehicles owned by private individual owners		– P300.00 per vehicle
b) Vehicles for business purposes and/or owned by sole proprietorships, partnerships, and corporations		– P500.00 per vehicle
c) Trucks (for truck ban conduct passes)		– P500.00 per vehicle

Section 12. Validity of exemptions

Exemptions shall be issued semi-annually. Applications for exemption approved during the first semester of the year shall be valid until June 30 while those approved during the second semester shall be valid up to December 31.

The MMDA shall issue exemption Certificates to be signed by the Chairman. The original copy of the certificate with the corresponding original copy of the Official receipt shall at all times be carried in the motor vehicle and shall be presented whenever required by traffic officials and enforcers.

Section 13. Repealing Clause

All previous memorandum circulars inconsistent with the foregoing are hereby modified, amended, or repealed accordingly.

Section 14. Separability Clause

If any part or provision of this Circular is held unconstitutional or invalid, other parts of provisions thereof which are not affected shall continue to remain in full force and effect.

Section 15. Effectivity

This Circular shall take effect on January 19, 2011.
