SUPPLEMENTAL RULES ON TRANSSHIPMENTS FOR FOREIGN
Pursuant to Section 608 of the Tariff and Customs Code, the rules and regulations on transshipment of cargoes/containers for foreign are hereby supplemented and modified accordingly, as follows:
I
OBJECTIVES
1.1 To prescribe the period within which transshipment cargoes for foreign may be allowed to stay in port.
1.2 To provide monitoring and control measures; and
1.3 To provide for fix customs supervision fees.

ADMINISTRATIVE PROVISIONS
2.1 Transshipments for foreign may stay in port for a maximum period of thirty calendar days.
2.2 No fees other than as hereunder specified in Par. 3.3 shall be billed and paid for customs extra services required.
2.3 The Deputy Collector for Operations of the Port shall be managerially responsible for the strict implementation of this Order.

OPERATIONAL PROVISIONS
3.1 After the corresponding Transshipment Permit is duly approved by the Deputy Collector for Operations or his authorized representative, the same shall be forwarded to the Piers and Inspector Division, or Customs Container Control Division as the case may be, for recording, implementation, and aging;
3.2 Cargoes/containers for transshipment staying in port beyond the period of thirty days shall be reported by PID or CCCD, as the case may be, to the Deputy Collector for Operations who, after informing the ESS and CIIS Supervisors in the Port, shall cause them to be moved to the area designated by the Terminal Operator for the purpose.
3.3 All such overstaying cargoes/containers shall be assessed a supervision fee of P800 per container, regardless of size, and/or P10 per revenue ton if breakbulk cargo, per day of extended stay, to be paid by the shipping company or agent concerned to the District Collector of Customs upon their loading or withdrawal.
3.4 The Deputy Collector for Operations shall take immediate action on every reported instance of tampering, substitution, diversion or unauthorized withdrawal, by securing the safety and preservation of the cargoes/containers, initially verifying the particulars of the incident, pinpointing responsibility and recommending the appropriate action for the District Collector of Customs to take.
All memoranda, orders and issuances not consistent herewith are hereby modified, amended or repealed accordingly.
This Order shall take effect immediately.
