WHEREAS, the Philippine Racing Commission (Philracom) has the exclusive jurisdiction and control over all aspects of the conduct of horses racing including the framing and scheduling of races,  the construction and safety of horse racing, the allocation of prizes, and the security of racing as provided for by the Presidential Decree No. 420;

WHEREAS,  under the same decree, the Philracom issued a set of Horse Racing Rules and Regulations which authorize the Philracom to impose fines, penalties, suspension, and forfeitures to erring parties including horses;

WHEREAS,  the Philracom Board of Commissioners sees the need to revisit the rule on Vicious horse covered under Rule 65 and 65-A of the Rules and Regulations on Horse Racing due to the length of the horse’s loading before it could be scratched from the race or be automatically withdrawn from the race;

WHEREAS,  the present rules provide that a horse that refuses to be loaded within five (5) minutes shall be automatically withdrawn from the race;

WHEREAS, the aforementioned time or period has proven to be too long that it results to obvious disadvantage to the horses loaded ahead in the starting gate;

WHEREAS, the Philracom Board of Commissioners proposes that the following rule be adopted:

C.  Refuses to be loaded within three (3) minutes (automatic withdrawal from the races and should pass the official barrier trial for vicious horses)
D.  (Deleted)

NOW THEREFORE, it BE RESOLVED, as its is hereby RESOLVED by the Philracom Board of Commissioners to adopt the earlier proposal to amend PR 65 of the Rules and Regulations on Horse Racing on Vicious Horses as follows:

RESOLVED FURTHER,  that copies of this resolution be published in the Kopya and the Official Gazette.
