[ MMDA RESOLUTION NO. 07-20, S. 2007, July 26, 2007 ]

APPROVING THE METRO CLEAR-ROADS 2008 PROGRAM OF THE METROPOLITAN MANILA DEVELOPMENT AUTHORITY



" WHEREAS, the rapid urban migration in Metro Manila has gradually destroyed its urban landscape and environment as numerous informal settlers have put up their shanties and ramshackle stalls along the roadways that obstruct and limit the space for pedestrians and motorists;

WHEREAS, even the business entrepreneurs and land owners took advantage of the opportunity that Metro Manila offers, for they have grabbed portions of the sidewalks by extending their houses and business establishments in order to earn more without regard to existing laws;

WHEREAS, these structures have contributed to the urban blight and clutters in Metro Manila that continue to project the face of poverty, a deteriorating quality of life and reflect a low regard on metropolitan governance;

WHEREAS, the government have invested a lot of money to build these roads and sidewalks but unfortunately some people have abused its utility by using some of its portions as sites for their trade/commerce;

WHEREAS, considering the limited road space and the traffic situation in Metro Manila, there is a need to maximize the use of these roads;

WHEREAS, as Metro Manila continues to gain its image as the country's model of a successful urban development, there is a need to remove all the blight and clutters to further improve and develop its surroundings;

WHEREAS, par. b Section 3 of RA7924, mandates MMDA to formulate, coordinate and monitor programs, policies, standards, programs and projects to rationalize the use of thoroughfares and promotions of safe and convenient movement of persons and goods in Metro Manila;

WHEREAS, the same law mandates MMDA to formulate, adopt and implement policies, standards, rules and regulations, programs and projects on urban renewal, zoning and land use to rationalize and optimize urban land use and provide direction to urban growth and expansion and the rehabilitation and development of slum and blighted areas;

WHEREAS, pursuant to the aforesaid mandate, the MMDA is launching the Metro Clear-Roads 2008 Program that aims to eliminate all urban blight and clutters and other forms of obstructions along the sidewalks to ensure smooth traffic flow and safe and convenient movement of persons and goods in Metro Manila;

WHEREAS, the Metro Clear-Roads 2008 Program involves projects and activities geared to provide comfort to the public and likewise improve the urban landscape of Metro Manila. These include, among other things, the improvement of sidewalks, provision of road, furniture and amenities and removal of illegally buift structures and other forms of obstructions along Metro Manila roadways to minimize/prevent roadside friction and provide fast and safe travel/movement of motorists and pedestrians;

WHEREAS, the Metro Manila Council, in session duly assembled, after due deliberation, recognized the need to approve the Metro Clear-Roads 2008 Program of the MMDA to address the problem on roadside obstructions caused by illegally built/installed structures.

NOW, THEREFORE, be it resolved as it is hereby resolved, that the Metro Manila Council, pursuant to Sec. 6 of RA 7924, hereby approves the Metro Clear-Roads 2008 Program of the MMDA.

RESOLVED FURTHER, that the Metro Manila Council hereby declares its commitment to make Metro Manila roadways free from urban blight and clutters by December 2008 towards the attainment of the Metro Clear-Roads 2008 Program in consonance to the provisions of RA7160 known as the Local Government Code of 1991 Towards this end, the Metro Manila Council, thru the Local Government Units shall:

1. Identify roadways where shanties, stalls and other urban blight and clutters proliferate;

2. Prevent city dwellers from constructing shanties, stalls and other similar structures along road rights of way/roadways/sidewalks;

3. Educate/disseminate information on laws regarding illegal structures/obstructions and explain the significance of such laws to city dwellers;

4. Shall (LGU) invite MMDA to assist on city roads and MMDA shall likewise invite LGU to assist on secondary roads;

5 Assist MMDA in the improvement/development of roadways/sidewalks MMDA shall extend logistical support, manpower, equipment, and such other resources necessary to clear the roads;

6. Follow and implement the guidelines provided for in the "Disiplina sa Bangketa" primer; and,

7. Undertake other activities deemed necessary to realize this Commitment.

This Resolution takes effect upon approval.
