SUSPENSION OF THE AUTOMATIC ONE PESO (P1.00) SAP LIEN INCREASE IN BINALBAGAN-ISABELA SUGAR CO., INC. (BISCOM) MILL DISTRICT EFFECTIVE CROP YEAR 1993-94



By virtue of the power vested upon the Secretary of Labor and Employment under Republic Act 6982 and upon the recommendation of the Sugar Tripartite Council (STC) in its meeting in Quezon City on 01 October 1993, the implementation of the automatic One Peso (P1.00) additional SAP lien provided for in Section 7 of RA 6982 in the BISCOM mill district is hereby suspended on account of the following:

a) Since the effectivity of RA 6982 in CY 1991-92, the plantation workers of BISCOM mill district have collected the Five Pesos (P5.00) per picul benefit provided under the law, equivalent to:

P 5,584,749.90 for CY 1991-92,
P 5,495,326.58 for CY 1992-93.

On the other hand, in compliance with Department Order No. 2, series of 1992, the workers have also continued to receive the three percent (3%) production share under RA 809, amounting to:

P 30,590,080.92 for CY 1991-92,
P 25,081,985.35 for CY 1992-93.

Hence, any further increase in the benefits accorded under Section 7 of RA 6982 will cause undue increases in the cost of producing sugar in the district considering that, at present, the planters milling with BISCOM are already paying two (2) simultaneous benefits as compared to other mill districts who give only benefits under RA 6982.

b) BISCOM district planters had incurred additional cost per ton cane P27.74 and P22.14 in the production of sugar in CY 1991-92 and 1992-93, respectively.  This additional cost in producing sugar had to be incurred by the district planters in view of the implementation of RA 809.  Consequently, the situation is aggravated by the downtrend in sugar prices.

c)  The petition to suspend the implementation of this particular provision emanated not only from the planters of the district but also from the farmworkers through their representatives in the District Tripartite Council, hence a unanimous indorsement.

This Order shall take effect starting Crop Year 1993-94 until revoked or modified pursuant to the Act.
