[ POEA GOVERNING BOARD RESOLUTION NO. 10, S. OF 2007, December 17, 2007 ]

DELEGATING THE SECRETARY OF LABOR AND EMPLOYMENT THE AUTHORITY TO ISSUE AND RENEW LICENSES TO RECRUITMENT AGENCIES



WHEREAS, Section 3 of Executive Order No. 247, series of 1987 conferred upon the Philippine Overseas Employment Administration (POEA) the authority to regulate private sector participation in the recruitment and overseas placement of workers by setting up a licensing and registration system;

WHEREAS, the authority granted to POEA was retained in Section 23, (b.1) of Republic Act 8042 (Migrant Workers Act) subject to deregulation and phase-out provisions of the Migrant Workers Act; the deregulation and phase-out provisions were subsequently repealed by Republic Act No. 9422 which thereby strengthened the POEA's regulatory functions;

WHEREAS, there is a need to rationalize the issuance and renewal of licenses to recruitment agencies by delegating the authority to issue and renew licenses to the Secretary of Labor and Employment.

NOW, THEREFORE, the POEA Governing Board, in a meeting duly convened, RESOLVED, AS IT HEREBY RESOLVES, to delegate to the Secretary of Labor and Employment the authority to issue and renew licenses to recruitment agencies. The POEA is hereby directed to promulgate the necessary guidelines to implement this Resolution.
