(NAR) VOL. 21 NO.2 APRIL - JUNE 2010

[ LTFRB MEMORANDUM CIRCULAR NO. 2010-023, May 12, 2010 ]

REITERATION THE PROVISIONS OF BP344, RA7277 (AS AMENDED BY RA9422), AND AMENDMENT TO MC NO. 89-010 ON THE ACCESSIBILITY OF PERSONS WITH DISABILITIES (PWDS) ON PUBLIC LAND TRANSPORTATION



Pursuant to the policy of the State to promote the mobility of persons with disabilities (PWDs), as well as to generate awareness of the rights of PWDs and foster understanding of their special needs, all grantees of Certificates of Public Convenience (CPC) issued by the Board are hereby required to observe the following:

- For PUBs

- Display of the International Symbol of Accessibility in the designated seats inside all units

- Regular buses shall have at least five (5) designated seats for PWDS near entrance doors

- Airconditioned buses shall have at least four (4) designated seats for PWDs near entrance doors

- For regular and airconditioned city buses, other passengers may use those designated seats if not occupied but shall yield them to incoming PWDs whenever the occasion arises.

- For provincial buses, other passengers may use those designated seats if no PWDs shall occupy these seats at the start of the trip

- Owners or operators of PUBs operating in highly urbanized cities shall install in their units audio-visual aids such as buzzers, bells, flashing lights to inform the driver of any alighting passenger.

- For PUJs

- Display of the International Symbol of Accessibility in the designated seats inside all units

- Provision of seats for PWDs during the trip. Other passengers may use those designated seats but shall yield them to incoming PWDs whenever the occasion arises.

- For Terminals/Stations/Garages

- Widen doors/access to comfort rooms to be able to allow the entry of wheelchairs.

- To provide ramps for easy access by wheelchairs to waiting lounge/s or passenger area

- To provide seats to PWDs with the corresponding markings on the chairs/benches. Other passengers may use those designated seats but shall yield them to incoming PWDs whenever the occasion arises.

No PUV shall deny to transport PWDs solely on account of their disability

Any operator found violating any of the provisions of this Circular shall be penalized as follows (in accordance with RA No. 7277, as amended): 

First Offense : P50,000.00
Second Offense: P100,000.00
Third Offense : Cancellation of Franchise/CPC

This Memorandum Circular supersedes any and all issuances inconsistent herewith and takes effect immediately following the publication in a newspaper of general circulation.
