[ LTFRB MEMORANDUM CIRCULAR NO. 2010-027, May 25, 2010 ]

APPLICATIONS FOR EXTENSION OF VALIDITY OF EXPIRED CERTIFICATE/S OF PUBLIC CONVENIENCE (MODIFYING MC NOS. 2009-006 & 2010-004).



Due to the clamor from various transport operators/groups and upon consultation with the different Regional Offices, the Board, in the exercise of its authority to promulgate rules and regulations in the operation of land-based public utility vehicles, hereby modifies, amends, revises MC Nos. 2009-006 & 2010-004 as follows:

1. Applications for extension of validity may be filed one (1) year prior to the date of expiration of the CPC;

2. Except CPCs covering Metro Manila Bus Operations, CPCs which expired within ONE (1) year after the date of the expiration shall be accepted for filing, subject to the following terms and conditions:

2.1 Penalty fee of TEN THOUSAND PESOS (PhP10,000.00) per unit.

2.2 In addition to the above-mentioned regular penalty, the following penalty shall also be imposed:

- PUJs, Taxis and School Transport Service - Php1,000.00/unit/month
- AUVs, Vans and Coasters (other denomination) - Php1,500.00/unit/month
- Trucks for Hire and Tourist Buses - Php2,000.00/unit/month
- PUBs (Provincial Operation only) - Php2,000.00/unit/month

2.3 Those applications which were approved under this category shall not be allowed to file application for sale and transfer and/or dropping and substitution of units within a period of two (2) years from date of issuance of decision, except in the following cases:

- When the purpose of the dropping and substitution is for dropping of phased out unit/s, or in conformity with the modernization standards of the DOTC and this Board;
- When the unit authorized was carnapped/stolen, provided that a Police Report or Certificate of Non-Recovery shall be presented;
- When the unit authorized suffered an accident resulting to destructive loss (total wreck), and rendering the said unit unserviceable provided that a Police Report shall be presented and that such accident was previously reported to the Board as required.

For purpose of this Memorandum Circular, the date of filing of the application/petition shall be on the date when the applicant/petitioner has fully paid the fees assessed by this Board and the receipt of this Board of the application/petition filed.

A Provisional Authority for non-extendible period of THREE (3) MONTHS shall be issued to the applicant and within such period the Decision granting the application for extension of validity of the CPC must be rendered and/or released. With the grant/release of the decision, the provisional authority issued shall be deemed automatically REVOKED.

All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular supersedes any and all issuances inconsistent herewith and takes effect immediately following the publication in a newspaper of general circulation.
