[ MTC RESOLUTION NO. 3, S. 2010, March 05, 2010 ]
AMENDING RESOLUTION NO. 11, SERIES OF 2009 ENTITLED “ADOPTION OF A STANDARD FORMAT FOR STCW ’95 CERTIFICATES AND THE SECRETARY OF THE DEPARTMENT OF LABOR AND EMPLOYMENT, CHAIRMAN OF THE MARITIME TRAINING COUNCIL, AS THE SIGNATORY TO THE ENDORSEMENT CERTIFICATE
WHEREAS, Resolution No. 11, Series of 2009 adopted a standard format for the STCW certificate issued by PRC, TESDA, NTC and the MTC Secretariat and such Certificates issued shall be endorsed by the Secretary of Labor and Employment as Chairman of the Maritime Training Council;
WHEREAS, in the light of the final draft of the amendments to the STCW Convention adopted by the STW 41, there is a need to realign the dispositive provisions of Resolution No. 11, Series of 2009 in accordance with the new definition of terms and the regulation on certificate and endorsement;
WHEREAS, Regulation I/1 (Definitions and Clarifications) has already defined the certificate of Competency (COC), Certificate of Proficiency (COP) and Documentary Evidence, and the certificates which requires endorsement by the Administration;
WHEREAS, under the existing provisions of the STCW Convention, and further retained in the final draft of the amendments, only the certificates of masters and officers shall be endorsed by the Administration.
WHEREAS, the cost of the printing of the endorsement forms to all certificates issued by TESDA, NTC and the MTC Secretariat is found too prohibitive and costly.
NOW, THEREFORE, the Council resolves as it is hereby resolved that:
1. Certificate of Competency (Reg. I/1.29), Certificate of Proficiency (I/1.30), and Documentary Evidence (Reg. I/1.36), issued by the concerned Agencies shall be strictly in accordance with the approved format contained in Resolution No. 11, Series of 2009;
2. Certificates of Masters and Officers issued by the Professional Regulation Commission (PRC) shall be endorsed by the Maritime Training Council in accordance with the approved format contained in MTC Resolution No. 11, Series of 2009;
RESOLVED FURTHER, that a copy of this Resolution together with the attached standard format of the STCW ’95 Certificates shall be communicated to the IMO Secretary- General and other Parties with whom the Philippines has a bilateral undertaking under Regulation I/10 of the revised STCW Convention.
RESOLVED FINALLY, that the MTC Secretariat shall formulate the implementing guidelines to be incorporated in the National Quality Standards System.
This Resolution shall take effect 01 June 2010.
