[ BOC CUSTOMS MEMORANDUM ORDER NO. 34-2010, August 31, 2010 ]

IMPLEMENTATION OF EXECUTIVE ORDER NO. 736



WHEREAS, an Intellectual Property Unit (IPU) in the Bureau of Customs was established through Customs Administrative Order No. 6-2002;

WHEREAS, Customs Special Order No. 19-2003 provides that the IPU shall be headed by the Chief, Internal Inquiry and Prosecution Division (IIPD);

WHEREAS, Executive Order No. 736 decreed the creation of permanent Intellectual Property Division in all enforcement agencies of the government;

WHEREAS, Customs Administrative Order (CAO) No. 9-2008 was promulgated to implement E.O. 736, creating for the purpose the Intellectual Property Rights Division;

WHEREAS, CAO 9-2008 has been published in a newspaper of general circulation;

NOW THEREFORE, by virtue of the authority vested in me by the Tariff and Customs Code of the Philippines in relation to Executive Order No. 292, the following are hereby directed:

1. Customs Special Order No. 19-2003 is hereby revoked

2. Customs Administrative Order No. 6-2002 is hereby deemed superseded by Customs Administrative Order No. 9-2008

3. The Intellectual Property Rights Division created under CAO 9-2008 is hereby separated from the Internal Inquiry and Prosecution Division.

4. Unless sooner revoked by another memorandum, CAO 9-2008 shall remain effective and the provisions therein shall have the effect of a valid law or regulation.

This memorandum shall take effect immediately.
