SUSPENSION AND/OR DEFERMENT OF THE DEADLINE FOR THE STORAGE OF ALL EXISTING DECOMMISSIONED POLYCHLORINATED BIPHENYLS(PCBS), PCB EQUIPMENTS AND PCBS OIL/FLUIDS



Pursuant to the relevant provisions of Republic Act 6969 otherwise known as "Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990," the DENR Administrative Order No. 29, series of 1992, known as the "Implementing Rules and Regulations of RA 6969," and DENR Administrative Order 2004-01, otherwise known as the Chemical Control Order for Polychlorinated Biphenyls (PCBs), this Circular hereby amends sub-section 5.2 of Section IV of DAO 2004-01 relative to the maximum storage period of ail PCBs.

I. PURPOSE

This Circular is being issued by the Department for the information of all concerned regarding the suspension or deferment of the deadline for the storage of all PCB and non-PCB equipment and fluids, for the time being that the construction and establishment of the disposal or destruction facilities for PCBs is still underway and not yet functional.

Thus, the allowable storage deadline which was scheduled last March 19, 2007 is hereby deferred and suspended until March 19, 2010, when the disposal or destruction facilities for ail decommissioned (existing, sealed, no leaks or drained of PCB fluids) PCBs is deemed available and operational.

II. SCOPE AND COVERAGE

The scope and coverage of this Circular shall comprise and encompass those that specifically cited in Section III, including sub-sections 1-4 of DAO 2004-01, series of 2004

III. REQUIREMENTS

All persons or entities covered by the CCO shall ensure compliance with the storage requirements of the CCO.

IV. REPEALING CLAUSE

All other Department Orders and issuances that are inconsistent herewith are deemed repealed, amended or modified accordingly.

V. EFFECTIVITY

The Circular takes effect upon its approval thereof and supersedes all other instructions inconsistent therewith.
