[ BOC CUSTOMS MEMORANDUM ORDER NO. 51-2010, November 03, 2010 ]

AMENDMENT TO CUSTOMS MEMORANDUM ORDER 46-98 DATED 03 NOVEMBER, 1998 ENTITLED “EXPEDITED CLEARANCE/RELEASE PROCEDURES AND GUIDELINES ON EXPRESS CONSIGNMENTS”



Pursuant to Section 608 of the Tariff and Customs Code of the Philippines as amended, the following guidelines are hereby issued amending CMO No. 46-98 on the expedited clearance/release procedures and guidelines on express consignments in the different international airports nationwide under the control and supervision of the Bureau of Customs.

Sec. 1 OBJECTIVES

1.1  To facilitate the clearance process of air consignments by providing for their consolidated processing.

1.2  To establish a simplified procedure in the processing of air consignments for their smooth and speedy clearance from the NAIA and other international airports in Customs territory nationwide.

1.3  To set uniform standards and operational guidelines in the consolidated processing of air consignments.

1.4  To ensure the collection of lawful government revenues and faithful compliance with laws and regulations being implemented and enforced by the Bureau of Customs.

Sec 2.    SCOPE

This Order shall cover air consignments carried either as freight or as baggage by Air Express Operators (AEO) and airfreight forwarders/consolidators except for the following:

1.5  Prohibited/Regulated Imports under Philippine laws;
1.6  Dangerous Goods;
1.7  Animal, fish and fowl whether live or frozen;
1.8  Foodstuff and highly perishable articles;
1.9  Human remains or cadavers;
1.10  Coins, cash, paper money and other forms of negotiable instruments equivalent to cash; and
1.11  Personal effects of Balikbayans, OFWs and other travelers.

Sec 3. Section 6.2.2 of CMO 48-96 is hereby amended to read as follows:

“6.2.2    For low-value Non-Docs Consignment

6.2.2.1 Low-value dutiable non-docs consignments shall be processed and cleared/released under consolidated informal entry or individually in cases where certain documentary requirements from other government agencies are still being secured or for some valid reason.
6.2.2.2 An Informal Import Declaration and Entry Form (BC Form 177) shall be filed together with the copy of the House Airway Bills (HAWBs) and corresponding commercial pro-form invoice as supporting documents, provided that one (1) consolidated informal entry shall cover not more than ten (10) individual HAWBs with different consignees.
6.2.2.3 A consolidated informal entry covering ten (10) individual HAWBs with different consignees shall not have an aggregate FOB value of not more than US$200.00, provided that an individual HAWB shall not have an FOB value of more than US$20.00, provided further that each HAWB  shall not exceed 5 kg by weight.
6.2.2.4 The consolidated informal entry must specify each and every HAWB it  covers, the number of packages for every HAWB, Description, Weight and Value.
6.2.2.5 Payment of the required fees shall be for every HAWB under the filed  consolidated entry.  For example, for a consolidated entry covering 10 HAWBs, payment of the prescribed fees shall be computed as follows:

6.2.2.6 Consignments under this category shall still be cleared/released based on selective documentary examination but shall undergo regular x-ray scan prior to release if found in order, without prejudice however to the Bureau’s conducting a physical examination of the content of any suspected package or at random prior to release.
6.2.2.7 Any consignment forming part of a consolidated informal entry found with a discrepancy shall be segregated and cleared/released after the appropriate action has been undertaken by Customs. Any misdeclaration or non-declaration of a consignment forming part of a consolidated informal entry shall be subjected to the appropriate enforcement action by the Bureau.

Sec. 4 SEPARABILITY CLAUSE

Provisions of existing orders, rules and regulations not affected by this Order shall remain in force and effect.

Sec. 5 EFFECTIVITY

This Order shall take effect immediately.
