[ PRC BOARD OF AGRICULTURE RESOLUTION NO. 04, S. 2009, April 01, 2009 ]

AMENDING SECTION 3 OF BOARD RESOLUTION NO. 09-A, SERIES OF 2005, (AMENDMENTS TO SEC. 26, D. AND SEC. 28, ART. VI OF BOARD RESOLUTION NO. 02, SERIES OF 2002, THE “RULES AND REGULATIONS IMPLEMENTING PRC RESOLUTION NO. 2000-663, SERIES OF 2000” AND BOARD RESOLUTION NO. 01, S. 2003, “AMENDMENTS TO SEC. 39, ARTICLE VIII OF BOARD RESOLUTION NO. 02, SERIES OF 2002”)



WHEREAS, the Board of Agriculture issued Board Resolution No. 09-A, Series of 2005 entitled, “Amendments to Sec. 26, D. and Sec. 28, Art. VI of Board Resolution No. 02, Series of 2002, the “Rules and Regulations Implementing PRC Resolution No. 2000-663, Series of 2002”, and Board Resolution No. 01, Series of 2003, amending Section 39, Article VIII of Board Resolution No. 02, Series of 2002”;

WHEREAS, Section 3 of Board Resolution No. 09-A, Series of 2005 has clarified Section 39 of Board Resolution No. 02, Series of 2002 on the requirements for registration of agriculturists without examination;

WHEREAS, the registration of agriculturists without examination shall terminate on December 31, 2008 as provided in the foregoing Resolution, notwithstanding the eventual passage of the professional regulatory law on the practice of agriculture;

WHEREAS, inasmuch as many agriculturists, beset with difficulties in obtaining the required documents, e.g., the certificate of live birth containing erroneous entry, the Ombudsman and NBI clearances in the provinces, could not possibly meet the December 31, 2008 deadline, they had requested the Board prior to such deadline to extend the period of registration of agriculturists, with at least five (5) years work experience prior to the effectivity of “AFMA of 1997”, without examination; and

WHEREAS, having considered the merits for the grant of the request of the Council of Deans and Heads of Schools for Agricultural Education-Region 10 (CDHSAE) and the Officers of Association of Colleges of Agriculture of the Philippines (ACAP); the Board decided to move for the amendment of the aforementioned Section 03;

NOW, THEREFORE, the Board resolves, as it is hereby resolved, to amend Section 03 of Board Resolution No. 09-A, Series of 2005, as follows:

Section 3. “Section 39 of Article VIII of Board Resolution No. 02, Series of 2002 on the registration of agriculturists without examination. – All applications for registration without examination as agriculturists shall be filed in the Central and Regional Offices of the Commission not later than December 31, 2010. Anybody who failed to file his/her application for registration as agriculturist without examination on or before December 31, 2010 and who wishes to become a registered and licensed agriculturist must take the licensure examination given by the Board of Agriculture;” (Italics supplied)

This resolution shall take effect after fifteen (15) days following the full and complete publication thereof in the Official Gazette, or in a newspaper of general circulation in the Philippines.

Let copies hereof be furnished to the Philippine Association of Agriculturists, Inc. (PAA), the Council of Deans and Heads of Schools of Agricultural Education-Region 10 (CDHSAE), CHED-recognized HEIs offering agriculture education programs, the Officers of Association of Colleges of Agriculture of the Philippines (ACAP), the Department of Agriculture and other government and private agencies where qualified applicants are connected, for dissemination to all concerned.
