[ PRC BOARD OF MEDICINE RESOLUTION NO. 34, S. 2009, June 22, 2009 ]

RESOLUTION ADOPTING THE CODE OF ETHICS PREPARED JOINTLY BY THE BOARD OF MEDICINE AND THE PHILIPPINE MEDICAL ASSOCIATION, INC.



WHEREAS, Section 9 of RA 8981 provides that the various Professional Regulatory Boards are mandated to regulate the practice of professions, monitor conditions affecting the practice/occupation, and adopt such measures to promote professionalism, standards and ethics;

WHEREAS, the BOARD OF MEDICINE (BOM) under REPUBLIC ACT No. 2382 otherwise known as the “Philippine Medical Act of 1959,” is mandated with the supervision, control and regulation of the practice of medicine in the Philippines;

WHEREAS, (BOM) is mandated to exercise the powers conferred upon it with the view of maintaining the ethical and professional standards of the medical profession;

WHEREAS, Sec. 24, Art. II of REPUBLIC ACT No. 2382 known as “The Medical Act of 1959” states, to wit: “Sec. 24. Grounds for Reprimand, Suspension or Revocation of Registration Certificate. – Any of the following shall be sufficient ground for reprimanding a physician, or for suspending or revoking a certificate of registration as physician: (1) Conviction by a court of competent jurisdiction of any criminal offense involving moral turpitude; (2) Immoral or dishonorable conduct; (3) Insanity; (4) Fraud in the acquisition of the certificate of registration; (5) Gross negligence, ignorance or incompetence in the practice of his or her profession resulting in an injury to or death of the patient; (6) Addiction to alcoholic beverages or to any habit forming drug rendering him or her incompetent to practice his or her profession, or to any form of gambling; (7) False or extravagant or unethical advertisements wherein other things than his name, profession, limitation of practice, clinic hours, office and home address, are mentioned. (8) Performance of or aiding in any criminal abortion; (9) Knowingly issuing any false medical certificate; (10) Issuing any statement or spreading any news or rumor which is derogatory to the character and reputation of another physician without justifiable motive; (11) Aiding or acting as a dummy of an unqualified or unregistered person to practice medicine; (12) Violation of any provision of the Code of Ethics as approved by the Philippine Medical Association. xxx The Certificate of Registration may be revoked or suspended xxx for violation xxx Code of Ethics for registered and licensed physicians.

WHEREAS, (BOM) and the PHILIPPINE MEDICAL ASSOCIATION, INC. (PMA) previously prepared a Code of Ethics hereto attached as Annex “A*”;

WHEREFORE, the Board resolves as it is hereby resolved, to adopt, promulgate and issue the “Code of Ethics for Registered and Licensed Physicians” (Annex A);

RESOLVED ALSO that copies of this resolution be furnished the Philippine Medical Association, Inc. (PMA), the duly Accredited Professional Organization recognized by the Board of Medicine, the Legal Division and all other Divisions of the Professional Regulation Commission (PRC) concerned;

This Resolution shall take effect after fifteen (15) days following the full and complete publication thereof in the Official Gazette, or in any newspaper of general circulation in the Philippines.
