[ LTFRB MEMORANDUM CIRCULAR NO. 2008-010, May 16, 2008 ]

AMENDMENT TO MC 2004-016, RE: APPLICATION FOR ISSUANCE OF CERTIFICATE OF PUBLIC CONVENIENCE TO OPERATE SHUTTLE SERVICE



In consonance with the program of the government of continuous economic development in Southern Luzon, this Board hereby modifies and amends MC 2004-016, RE; APPLICATION FOR ISSUANCE OF CERTIFICATE OF PUBLIC CONVENIENCE TO OPERATE SHUTTLE SERVICE dated May 26, 2004, by excepting Southern Luzon specifically in Special Economic Zones (PEZA) on the type of vehicles allowed as Shuttle Service in order avoid any obstruction of economic mobility in the said region.

Thus, Application for Issuance of Certificate of Public Convenience to operate Shuttle Service on Special Economic Zones (PEZA) in Southern Luzon with the use of Asian Utility Vehicles, Vans, and Jitneys are now allowed for acceptance, subject to the following conditions:
  1. The shuttle contract should particularly provides that the use of type of units mentioned in the immediately preceding paragraph be utilized in the service for there are routes requiring these vehicle sizes because of road limitations in special areas, rendering the said vehicles the only means available. Regional Director of Regional Office IV should certify that unit/s to be utilized under this type of service are the only means available due to the road limitations in special areas;

  2. The units proposed to be authorized as shuttle service should have passed the roadworthiness test standards to be conducted by the personnel of this Board;

  3. The conditions as provided for under MC 2004-016 which are not inconsistent herewith should likewise be complied with upon filing of the Application;

  4. The unit/s authorized should be painted in bold letters (8 inches x 5 inches) the word "SHUTTLE SERVICE" in front and both sides for proper identification of service; and

  5. The fare rates shall be regulated by this Board.
All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular shall take effect immediately.
