ACCREDITATION OF TRANSPORT GROUPS AND/OR TRANSPORT ASSOCIATIONS



BACKGROUND:

No less than the 1987 Constitution has recognized the role of people's organization as conduits in the promotion of public interest through peaceful and lawful means.

It has been likewise been established that public land transport is imbued with public interest.

Thus, pursuant to Section 5(k) of Executive Order No. 202 which grants the LTFRB the power and function to "formulate, promulgate, implement, and enforce rules and regulations on land transportation utilities" and in line with the national government's policy to uphold public interest at all times, the Board deems it necessary to adopt guidelines and procedures for the accreditation of transport groups and associations as part of its consultation mechanism.

GUIDELINES AND PROCEDURES:
  1. Only duly accredited transport organizations and/or associations shall be:

    (a) allowed to file petitions/applications and/or oppositions and
    (b) entitled to notices of hearings/consultative meetings on vital issues affecting public land transportation, as the Board may determine.

  2. To acquire accreditation, transport organization and/or associations shall file their application/petition for accreditation with the Board, upon payment of the required accreditation fee and attaching thereto the following documentary requirements:

    • Articles of Incorporation and By-Laws including contact numbers and addresses
    • Duly authenticated SEC Certificate of Registration
    • List of Officers and their respective Personal Data, including contact numbers and addresses.
    > Officers of said transport group/association should be legitimate franchise holders/CPC grantees themselves.
    • List of Members, who should all be legitimate franchise holders/CPC grantees, including their respective Case Numbers
    • List of Routes granted to its Members

  3. Upon approval by the Board of the petition/application, the corresponding Certificate of Accreditation shall be issued to eligible transport groups and/or associations.

  4. In case a transport group/association belongs or is affiliated with a federation or national organization, the Board shall allow accreditation to be facilitated through the federation or national organization. However, as additional documentary requirement, the federation or national organization concerned shall include a list all of its local transport group/ association members.

  5. Said Certificate of Accreditation shall be valid within one (1) year from date of issuance. However, upon just cause, the Board may cancel said Certificate of Accreditation prior l0 expiration.

  6. For renewal of accreditation, the transport group/association shall file the necessary petition/application for renewal of accreditation, and attaching thereto an updated list of officers and members.
This Memorandum Circular shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
