[ LTO MEMORANDUM CIRCULAR NO. 670-2005, December 12, 2005 ]

ONLY STUDENT DRIVER APPLICANTS WHO FAILED IN THE EXAMINATION FOR NEW LICENSE SHALL TAKE ANOTHER EXAMINATION AT LEAST ONE MONTH THEREAFTER



It has been observed that all applicants for driver’s license who failed in the license examination regardless of type of application are allowed to take another examination at least one month thereafter. This practice at the Licensing Centers/District Offices runs counter to the provisions of Sec. 30 of RA 4136, which provides that:

 

“A Student Driver who fails in the examination on professional or non-professional license shall continue as Student Driver and shall not be allowed to take another examination at least one month thereafter.”

Student Driver referred to in the aforestated provision is a holder of a Student Permit and applying for a new license, who failed in the new license examination and therefore covered by the said provision.

For further information and guidance of all concerned, listed hereunder are license transactions not covered by Sec. 30 of RA 4136.

    1. Delinquent for more than two (2) years or more.
    2. Change status from non-professional to professional
    3. Additional restriction code
    4. Conversion of expired foreign license

Applicants of the above-mentioned transactions who failed in the examination shall be allowed to take another examination anytime at their convenience and preference after payment of twenty-five (pesos (P25.00) application fee.
