[ LTO MEMORANDUM CIRCULAR NO. 681-2006, February 15, 2006 ]

UNAUTHORIZED INSTALLATION OF MOTOR VEHICLE LICENSE PLATES AND VALIDATING STICKERS



Whereas, it has been observed and noticed that a number of motor vehicles are operating on national roads, streets and highways with improperly displayed or otherwise unreadable license plates. Further, the validating stickers are improperly attached and affixed to the license plates, making the identification of motor vehicle plates difficult or otherwise futile;

Whereas, monitoring and apprehension of motor vehicles used in the commission crime is of urgent matter;

Whereas, carjacking is now an immediate concern of law enforcement agencies;

Whereas, pursuant to the provisions of R.A. 4136, otherwise known as the “Land Transportation and Traffic Code”, specifically Section 18 thereof, and Memorandum Circular No. 84MC-DIR-002, dated 03 January 1984, the following guidelines have already been set forth for the compliance of all motor vehicle owners regarding the proper installation for easy identification of license plates and validating stickers, to wit:

 

“Sec. 18, R.A. 4136 Use of License Plates – At all times, every motor vehicle shall display in conspicuous places, one in front and one in the rear thereof, the said license plates.”

 

“The aforesaid license plates shall be kept clean and cared for, and shall be firmly affixed to the motor vehicle in such a manner as will make it entirely visible and always legible. xxx.”

 

“Sec. I, M.C. No. 84MC-DIR-002”

 

“Placement of the Windshield Validating Sticker – The windshield-validating sticker shall be placed on the upper right corner of the windshield. All other old stickers found on the windshield of the vehicle shall be removed to avoid any obstruction of view of the driver.”

 

“Placement of the Year Tag Stickers – the year tag stickers shall be placed on the bottom right rectangular slot specifically designed in the plate for the purpose. All other old stickers found on the space provided therein shall be removed to avoid confusion, and to make motor vehicles easily recognizable, entirely visible and always legible for the public and law enforcement officers.”

Wherefore, all Law Enforcement Officers and Deputized Agents of this Office are hereby directed to immediately apprehend all motor vehicles found violating the above-quoted provisions in accordance with the adopted rules of Apprehension.

Further, the penalty of Three Hundred Pesos (Php 300.00) under Sec. 20 of Department Order No. 93-693, dated November 19, 1992, shall be imposed upon the owner of the motor vehicle for violation thereof.

Lastly, let a copy of this Memorandum Circular be immediately posted on all District and Extension Offices for public information and guidance.

All orders, memoranda, circulars, and issuances inconsistent herewith are deemed superseded and revoked.
