[ NPC RESOLUTION NO. 2006-082, March 03, 2006 ]

SUPERINTENDENT AND HIGHER IN THE PHILIPPINE NATIONAL POLICE, AMENDING FOR THE PURPOSE NAPOLCOM RESOLUTION NO. 2002-034



WHEREAS, the Commission under Section 14 of Republic Act 6975, as amended by Section 5 of Republic Act 8551, has among others, the function to “[D]evelop policies and promulgate a police manual prescribing rules and regulation for efficient organization, administration, and operation, including criteria for manpower allocation, distribution and deployment, recruitment, selection, promotion, and retirement of personnel and the conduct of qualifying entrance and promotional examinations for uniformed members;”

WHEREAS, Section 32 of RA No. 6975, as amended, specifically provides that “[T]he National Police Commission shall administer the entrance and promotional examinations for policemen on the basis of the standards set by the Commission.”;

WHEREAS, vis-à-vis the above provisions is Section 38 of RA No. 6975 as amended, which states that “(a) A uniformed member of the PNP shall not be eligible for promotion to a higher position or rank unless he or she has successfully passed the corresponding promotional examination given by the Commission, or the Bar, or the corresponding Board examination for technical services and other professions. x x x x.”;

WHEREAS, in the exercise of these powers and functions on personnel action, the Commission on December 5, 1997, issued Resolution No.97-218, entitled “Further Revising the Qualification Standards for PNP Ranks”, which in the attached matrix thereof the eligibility requirement for the ranks of Senior Superintendent to Director General is either Career Service Executive Eligibility (CSEE) or Career Executive Service (CES); which Resolution was further amended on March 26, 2002 by Resolution No. 2002-034;

WHEREAS, the Commission, after a thorough study and research and in the interest of the police service, has come up with its own sets of battery test which are germane and compatible with police work to gauge the competence, knowledge, skills and managerial expertise of senior police officers;

NOW, THEREFORE, the Commission, in the exercise of its constitutional mandate to administer and control the PNP vis-à-vis its statutory powers and functions under Republic Act No. 6975 as amended by Republic Act 8551, has resolved to prescribe as it hereby prescribes that the eligibility requirement for the ranks of Senior Superintendent and higher in the PNP shall be the Police Service Executive Eligibility which will be granted to senior police officers who pass the police service executive examination administered by the National Police Commission.

All issuances contrary to or inconsistent with this Circular are hereby modified or repealed accordingly.

Let a copy of this Resolution be furnished the Office of the President and the Chairperson, Civil Service Commission for their information and reference.

This Resolution shall take effect upon approval.
