REVISED IMPLEMENTING GUIDELINES FOR MMDA RESOLUTION NO. 11-02, SERIES OF 2011, ENTITLED “STRICTLY IMPLEMENTING VEHICLE TAGGING BY PAINTING THE LICENSE PLATE NUMBER ON THE ROOF OF ALL REGISTERED AND FRANCHISED PUBLIC UTILITY VEHICLES (PUVS) PLYING ALONG MAJOR AND SECONDARY THOROUGHFARES OF METRO MANILA PURSUANT TO MMDA RESOLUTION NO. 02-27, SERIES OF 2002, AND SECTION 7 (D) OF RA 7924
<DIV ALIGN=JUSTIFY><B>1.0 RATIONALE</B>
Republic Act No. 7924 mandates that the MMDA shall set the policies concerning traffic in Metropolitan Manila, and coordinate and regulate the implementation of all programs and projects concerning traffic management specifically pertaining to enforcement, engineering and education.
Effective traffic enforcement, engineering and education are key factors to increase public safety for motorists, commuters, passengers and pedestrians. Traffic enforcement measures being implemented by the Authority include the “No Physical Contact Policy”, anti-colorum operations and enforcement of prescribed speed limits along major thoroughfares.
In line with the implementation of the “No Physical Contact Policy”, Closed Circuit Television (CCTV) cameras were placed at strategic locations throughout Metro Manila. However, the CCTVs could not clearly capture images/pictures of license plates of motor vehicles involved in traffic violations or accidents, due to the cameras’ limited visual range and capacity, especially when the vehicles are in motion.
The Authority also implemented a vehicle tagging process in order to identify and segregate duly-authorized public utility buses from colorum. The authority also began utilizing speed guns along Commonwealth Avenue to detect and apprehend speed limit violations, also under the “No Physical Contact Policy.”
To further enhance and improve these traffic enforcement measures, the Metro Manila Council approved MMDA Resolution No. 11-02, Series of 2011, re-implementing MMDA Resolution No. 02-27, Series of 2002, authorizing the MMDA Chairman to “tag” Public Utility Vehicles (PUVs) by requiring the painting of license plate numbers on the roof, front, back and two sides of all registered and franchised PUVs. This will enable CCTV cameras to easily capture the license plate numbers of vehicles plying major and secondary thoroughfares in Metro Manila involved in traffic violations and accidents, to facilitate their identification and apprehension.
<B>2.0 PURPOSE</B>
This Revised Memorandum Circular provides guidelines and procedures in the implementation of MMDA Resolution No. 11-02, Series of 2011, in relation to MMDA Resolution No. 02-27, Series of 2002, in order to have a uniform interpretation and strict implementation of the said policies.
<B>3.0 VEHICLE TAGGING OR MARKING</B>
The following guidelines should be observed in the implementation of MMDA Resolution No. 11-02:

<td colspan="4"><strong>“Major and secondary thoroughfares”</strong> for purposes of these Implementing Guidelines shall mean Highways, Avenues, Boulevards and Streets within Metro Manila classified as such by the Department of Public Works and Highways (DPWH).</td>

<td colspan="4"><p> This Circular shall cover all registered and franchised Public Utility Vehicles (PUVs) plying major and secondary thoroughfares in Metro Manila, including City and Provincial Operation Buses (PUBs), Public Utility Jitneys (PUJs) and Taxi cabs whether metered or garage to terminal. It shall not include airport taxis and PUJs plying short trips along local or interior roads, provided that the latter do not traverse a great portion of any major or secondary thoroughfare within Metro Manila.</p></td>

<td colspan="3">New PUVs and PUVs which have not yet complied with the tagging or marking requirement on the sides and at the back of the vehicle pursuant to relevant LTFRB Regulations shall be required to have their vehicles painted accordingly, the dimensions of which shall not be smaller than one-third the size of the roof mark.</td>

<B>4.0 IMPLEMENTING PROCEDURE</B>

<td colspan="2"><p>Additional Closed Circuit Television Cameras (CCTVs) from the DOTC shall be distributed and installed at strategic points along major and secondary thoroughfares throughout Metro Manila, taking into account among others PUV converging and diverging points, loading and unloading zones, accident prone areas as well as areas where traffic is crucial during rush hours.</p></td>

<td colspan="2"><p>Any PUV spotted or captured by CCTV Cameras violating MMDA Resolution No. 11-02, Series of 2011, shall be proceeded against and penalized, in accordance with MMDA Memorandum Circular No. 04, Series of 2011, or the Revised Implementing Guidelines of MMDA Resolution No. 10-12, otherwise known as the “No Physical Contact Policy” of the MMDA.</p></td>

<td colspan="2"><p> The owners/operators/franchise holders of all covered PUVs shall have a period of three (3) months from the effectivity of these Revised Implementing Guidelines within which to comply with the above-mentioned directive. Failure of owners/operators/ franchise holders to do so shall be meted out appropriate sanctions including but not limited to: (a) a fine of five hundred pesos; and/or (b) recommendation for CANCELLATION/SUSPENSION OF FRANCHISE to the LTFRB by the MMDA.</p></td>

<td>4.5 </td>
<td colspan="2">For purposes of this policy, the MMDA shall regularly coordinate and consult with the LTFRB and other concerned agencies to facilitate procedures in the enforcement and supervision thereof.</td>

<B>5.0 SEPARABILITY CLAUSE</B>
If any of the provisions of this Revised Memorandum Circular is declared unconstitutional or invalid for whatever reason, the same shall not affect the validity of other provisions not declared unconstitutional or invalid.
<B>6.0 REPEALING CLAUSE</B>
All other Memorandum Circulars or related issuances contrary or inconsistent herewith are hereby accordingly repealed, amended or modified.
<B>7.0 EFFECTIVITY</B>
This Memorandum Circular shall take effect immediately.
