[ PNP MEMORANDUM CIRCULAR NO. 2011-013, May 17, 2011 ]

AMENDING PARAGRAPH 6.B OF PNP MEMORANDUM CIRCULAR NO. 2011-005 AND PROVIDING POLICIES ON THE BEARING AND CARRYING OF HIGH-POWERED FIREARMS OUTSIDE OF RESIDENCE



1. REFERENCE:

PNP Memorandum Circular No. 2011-05 dated January 16, 2011 “Rationalized Policies on the Possession, Bearing and Carrying of Firearms (Revised)”.

2. AMENDMENT:

Paragraph 6.b PNP MC No. 2011-005 is hereby amended to read as follows:

“Should a firearm licensee so desire, he/she may apply for a Permit to Carry Firearm Outside of Residence (PTCFOR) for every licensed privately-owned Low Powered Firearm (LPFA) and one (1) licensed privately-owned High Powered Firearm (HPFA) provided he/she meets the conditions and qualification set forth herein”.

3. POLICIES ON THE BEARING AND CARRYING OF HPFA COVERED WITH PTCFOR:

a. Permit to Carry Firearm Outside of Residence (PTCFOR) for HPFA may be granted to members of the PNP, AFP, Law Enforcement Agencies (LEAs) and other government officials enumerated herein, who by the very nature of their present position and occupation are exposed to actual threat and imminent danger from lawless elements, but subject to the following restrictions and conditions:

1. Permit to Carry Firearm Outside of Residence for HPFA shall be limited to firearm with:

a. Caliber .22 rim fire and 9mm, standard magazine fed and with firing capability of full automatic or by burst of two or more; and
b. Caliber .357, .40, .41, .44, .45.56mm and 10mm, standard magazine fed and with firing capability of full automatic, semi automatic or single shot.

2. Carrying of HPFAs is prohibited in Metro Manila, chartered cities, provincial capitals, and other thickly populated areas or in fiestas or other large gatherings except in the actual performance of duty or accomplishment of mission;
3. The PTCFOR for HPFAs shall only be issued by the Chief, PNP and shall be valid for one (1) year subject to review prior to renewal and may be revoked or suspended upon the discretion of the issuing authority;
4. A firearm licensee shall be limited to carry only one (1) firearm covered with PTCFOR at any instance;
5. A HPFA subject of the PTCFOR, must always be carried in a secured case or box and must never be displayed; and
6. PTCFORs are non-transferable.

b. Only the following government officials may apply for PTCFOR for licensed privately-owned HPFAs:

1. President
2. Vice-President;
3. Members of the Senate and the House of Representatives;
4. Cabinet Members;
5. Governors;
6. Justices of Supreme Court, Court of Appeals and Court of Tax Appeals;
7. Justices of the Sandigan Bayan;
8. Ombudsman;
9 Judges of the Regional Trial Courts and Lower Courts; and
10. Members of the PNP, AFP and other law enforcement agencies in the third level positions or with salary grade 26 or higher.

c. Additional requirements for the issuance of PTCFOR for HPFAs:

1. Appointment Order and Oath of Office for appointed/elected officials;
2.Clearance from the PTCFOR Secretariat that the HPFA is eligible for PTCFOR application; and
3. Other requirements which may be required by the PTCFOR Secretariat.

4. IMPLEMENTING GUIDELINES:

a. The Civil Security Group, jointly with PTCFOR Secretariat, shall issue such appropriate guidelines to implement the Provisions of this Memorandum Circular.
b. The Directorate for Police Community Relations, jointly with the PCRG and the PIO, shall issue necessary guidelines in order to sustain the PNP’s advocacy on the declaration of gun-free zones in the country.

5. AMENDING CLAUSE:

All previous issuances not consistent herewith are deemed amended and/or rescinded accordingly.

6. EFFECTIVITY:

This Memorandum Circular shall take effect after fifteen (15) days from the filing of a copy hereof at the University of the Philippines Law Center pursuant to Sections 3 and 4, Chapter 2, Book VII, of Executive Order No. 292, otherwise known as the “Revised Administrative Code of 1987”, as amended.
