[ SRA SUGAR ORDER NO. 10-A, SERIES OF 2007-2008, April 23, 2008 ]

ADDENDUM TO SUGAR ORDER NO. 10 DATED 14 APRIL 2008 RE: REINSTATEMENT OF EXPIRED (HOMELESS) "A" QUEDANS INTO "A" OR U.S. QUOTA SUGAR AND REVISED VERIFICATION AND SHIPMENT SCHEDULES OF "A" OR U.S. MARKET SUGAR



WHEREAS, the rationale of Sugar Order No. 10, Series of 2007-2008 is to ensure the filling up of our U.S. Quota;

WHEREAS, there had been requests for reinstatement and verification submitted and filed with SRA before Sugar Order No. 10. dated April 14, 2008. was officially released for implementation;

WHEREAS, in granting said requests, there is a need to revise certain provisions in the said Sugar Order 10;

NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration [SRA], it is hereby ordered that:

SECTION 1. Sections 1.2.1, 1.2.2 and 1.6 of Sugar Order No. 10, dated 14 April 2008, Series of 2007-2008 is hereby amended to read as follows:
"1.2.1 For homeless "A" sugar produced from week ending September 2 2007 to November 25, 2007, a reinstatement fee of P10.00 per LKg-Bag plus an additional P1.00 per LKg-Bag per day computed from the original reinstatement deadline of February 29, 2008 until verification/reinstatement application date, shall be paid upon filing of the application for verification and reinstatement with the SRA. Applications received before dated April 14, 2008, took effect are, however, exempted from the payment Of an additional P1.00 per LKq-Baq per day but shall only pay the PJCTPTTJ^ LKg-Bag reinstatement fee."

"1.2-2 For homeless (expired) "A" produced from weekending December 2-January 27,2008, a reinstatement fee of P1.00 per LKg-Bag per day computed from the original deadline for verification of March 13, 2008 until verification/ reinstatement application date, shall be paid upon filing of the application for verification and reinstatement with the SRA. Applications received before_Sugar Order No. 10, dated Aph! 14, 2008, took effect are, however, exempted from the payment of an additional P1.00 per LKq-Bag per day but shall only pay the P10.00 perLKg-Bag reinstatement fee."

"1.6 An Undertaking to Ship "A" Sugar to the United States shall be signed by the trader/exporter, indicating his commitment to (a) ship the "A" sugar on or before the schedule as established/set by Sugar Order No. 10 and (b) to comply with all the terms and conditions therein set forth, shall be part of the verification requirements of said trader/exporters. Sugar Planters presenting their "A" sugar for verification are, however, exempted from this requirement, provided that this same sugar is committed by an exporter for shipment to the United States."
SECTION 2. To emphasize the necessity of compliance to Sugar Order No. 10, Series of 2007-2008 (S. 07-08) and to avoid penalty or additional expenses on the part of the quedan holders, the following provisions in Sugar Order No. 10T S. 07-08 are hereto, re-published for the clarification and guidance of all concerned:
"1.4 In order to ensure the filling up of the U.S. quota at the appropriate time, the deadlines for verification and nomination of vessel of "A" sugar including those of the old crop years are hereto, published as follows:

"1.5 The subject "A" quedans if not verified with the SRA-Quezon City or failed to comply with the nomination of vessels on or prior to the above-mentioned deadlines shall be classified as "HOMELESS" or "EXPIRED" quedans and its covering sugar is a non-status or non-marketable sugar which cannot be withdrawn from the mills. No further reinstatement shall be allowed until the end of crop year.2007-2008."
SECTION 3. Separability Clause. Provisions of Sugar Orders, Circular Letters, and/ or other rules and regulations contrary to or inconsistent with this Sugar Order, are hereby revised, modified or revoked accordingly.

SECTION 4. Consistency. Other provisions of the aforesaid Sugar Order No. 10 shall remain in full force and effect.

SECTION 5. Effectivity. This Order-shall take effect immediately.
