[ SRA SUGAR ORDER NO. 8, S. 2010-2011, May 03, 2011 ]

FILLING UP THE ADDITIONAL U.S. QUOTA ALLOCATION FOR QUOTA YEAR 2010-2011 AND VERIFICATION AND SHIPMENT SCHEDULES



WHEREAS, the Philippines regular U.S. quota allocation for Quota Year 2010-2011 has been increased with an additional quantity of 60,000 Metric Tons Raw Value (MTRV) or 57,485.03 Metric Tons Commercial Weight (MTCW);

WHEREAS, the “First Come-First Served” policy of allocating the additional U.S. Quota among sugar traders/exporters shall apply;

WHEREAS, in order to ensure the timely filling up of the additional U.S. Quota before the end of July and the arrival date by the end of September, nomination of vessel by qualified sugar traders/exporters shall be required;

WHEREAS, Sugar Order No. 13, Series of 2009-2010, which provides for the reinstatement of homeless “A” sugar of Crop Year 2009-2010 and previous crop years into “A” or U.S. Quota sugar is still in force and effect;

NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), the following is hereby ordered:

Section 1. The additional U.S. Quota Allocation for Quota Year 2010-2011 shall be allocated among the sugar exporters on a “First Come-First Served” basis.

In the event the exporter shall have sold his verified “A” quedan-permits to another party, the allocation of the said exporter is deemed cancelled, in which case, the said “A” quedan-permits shall be again subject to verification by the SRA for allocation on a “First Come-Served” basis.

Section 2. Deadline of Submission for Verification of “A” quedans for the additional U.S. Quota.

2.1 In order to ensure the filling up of the additional U.S. Quota at the earliest time possible, hereunder is the scheduled deadline of submission of “A” quedans of CY 2009-2010 and CY 2010-2011 to the Regulation Department (RD), SRA, Quezon City for verification:

2.2. The subject “A” quedans if not verified with the SRA on or prior to the said deadline shall be considered as “HOMELESS” and reinstated prior to verification upon payment of P1.00 per Lkg-bag per day.
2.3 Nomination of vessel by qualified sugar traders/exporters shall be required through an undertaking to ship to the SRA prior to the deadline of shipment.

Section 3. Reinstatement and Verification of “A” Quedans of CY 2008-2009 and Prior Years.

The “A” quedans of CY 2008-2009 and previous crop years shall be subject for reinstatement prior to verification of “A” U.S. Quota sugar.

3.1 A reinstatement fee of Ph60.00 per Lkg-bag plus Ph1.000 per Lkg-bag per day (per Sugar Order No. 13, Series of 2009-2010) shall be paid upon filing of the application for reinstatement with SRA.
3.2 The deadlines for verification and shipment of “A” quedans of CY 2008-2009 and prior years shall be the same as Section 2.1 above. Thus, the reinstatement of said quedans shall be done prior to the verification date.
3.3 The subject “A” if not verified with the SRA shall remain as “HOMELESS” quedans and its covering sugar is a non-status or non-marketable sugar which cannot be withdrawn from the mills.  No further reinstatement shall be allowed thereafter.

Section 4. All “A” quedans subject of reinstatement shall be stamped at the back thereof as “Reinstated “A” or U.S. Quota Sugar per S.O. No. 8, Series of 2010-2011.

Section 5. This Sugar Order shall take effect immediately.

Section 6. Provisions of Sugar Orders, Circular Letters and/or other rules and regulations contrary to or inconsistent with this Sugar Order are hereby amended, modified or revoked accordingly.
