[ POEA MEMORANDUM CIRCULAR NO. 39, S. 1995, July 05, 1995 ]

IMPLEMENTING GUIDELINES ON EXEMPTION FOR PERFORMING ARTISTS FROM TRAINING, TESTING AND PRE-DEPARTURE SHOWCASE PREVIEW



Pursuant to Department Order No. 18* Series of 1995, the following implementing guidelines on the grant of exemption for artists with outstanding performance records from the mandatory training, testing and pre-departure showcase preview are hereby issued:

1. In its evaluation of the quality of local performances/employment of the artist-applicant, the POEA shall seek the assistance of other entities such as but not limited to the Department of Tourism, the National Commission on Culture and Arts, and the Film Academy of the Philippines.

2. The Office of the Labor Attache or the Philippine Embassy/Consulate shall attest to the quality and venues of the overseas performances/employment of the artist-applicant.

3. The minimum performance record of one year required of the artist-applicant may be a continuous experience under one venue/company or an accumulation of experiences under several venues/companies.

4. The POEA reserves the right to verify the authenticity of documents submitted by the artist-applicant and may at any time require additional proofs of the artist's record/background such as but not limited to awards and testimonials.

5. Upon satisfaction of all the requirements, the artist-applicant shall be granted an Artist Record Book (ARB) for the skill by which he/she gained the most performance experiences.

6. The ARB that shall be granted to an artist with herein described outstanding performance shall be valid for 3 years. Upon its expiration, the artist-holder shall apply for its renewal with the presentation of updated employment/performance records.

7. An artist who is granted an ARB under these guidelines shall be exempted from undergoing the Pre-Departure Showcase Preview if he/she will be leaving in a group all of whose members secured their ARB's under these guidelines as well.

8. All applications for ARB under these guidelines and the accompanying documents shall be filed with the POEA's Manpower Registry Division. Approval of the application shall be granted by the POEA Administrator.

These guidelines shall take effect immediately.
