[ PHILRACOM RESOLUTION NO. 22-10 S. 2010, June 23, 2010 ]

AMENDMENT TO PR 35



WHEREAS, the Philippine Racing Commission (Philracom) has the exclusive jurisdiction and control over the conduct of horseracing including the framing and scheduling of races as provided in Presidential Decree No. 420;

WHEREAS, the Philracom has the authority to impose sanctions/penalties on erring jockeys;

WHEREAS, the Rules and Regulations, PR 35, provides:

PR 35. ALLOWING A SUSPENDED JOCKEY TO RIDE IN A STAKES RACE - A suspended jockey who is already declared in a stakes race at the time of his suspension should take part in the said race or races. His suspension will take effect the day after his declared ride. In the case of Stakes Race, the period between the date of suspension and the race wherein he was previously declared shall be counted in the computation of his penalty.

WHEREAS, there is a need to widen the scope of the provision to include incidents pertaining to suspended jockeys;

NOW THEREFORE, the Philracom resolves, as it hereby resolved, to amend PR. 35 to read as follows:

PR 35. ALLOWING A SUSPENDED JOCKEY TO RIDE - a suspended jockey will still be allowed to ride if he has already been declared for a race prior to his suspension.

1. In cases where the length of suspension is two (2) weeks or less, he is still eligible for declaration provided that his case is on appeal. His suspension will commence the day after a final ruling of the Commission upholding the penalty is made.

2. In cases where the suspension is more than twelve (12) racing days, the jockey will not be eligible for declaration for future races whether his case is on appeal or not. His suspension will start a day after his last ride.

3. In the case of stakes races, the period between his date of suspension and the race wherein he was previously declared shall be counted in the computation of his suspension.

4. Failure by the Club Handicapper to implement this provision will mean a corresponding penalty which will be determined by the Philracom Board.

RESOLVED FURTHER, that copies of the attached guidelines be published and furnished to all the parties concerned for their proper guidance.
