[ PHILRACOM RESOLUTION NO. 23-10 S. 2010, July 22, 2010 ]

ALLOWING THE REVIEW OF THE PENALTIES OF SUSPENSION OF ERRING JOCKEYS



WHEREAS, the Philippine Racing Commission (Philracom) has the exclusive jurisdiction and control over the conduct of horseracing including the framing and scheduling of races, the construction and safety of horse-racing, the allocation of prizes and the security of racing as provided in Presidential Decree No. 420;

WHEREAS, pursuant to the said mandate, the PHILRACOM Board of Commissioners have the power to impose penalties such as, but not limited to, fines and disqualification;

WHEREAS, the Philracom Board of Commissioners has earlier passed Resolution No. 21-10 allowing an erring jockey to have his penalty of suspension be reviewed and modified despite the lapse of the seventy-two-hour period to appeal if circumstances so warrant upon payment of Php 1,500.00;

WHEREAS, there are petitions from jockeys received by the Philracom Board of Commissioners requesting for the review and reconsideration of their penalties of suspension even if they are already serving the same after their earlier appeals were denied by the Commission;

WHEREAS, in the interest of justice and for humanitarian reasons, the Philracom Board of Commissioners has decided to allow the review of the penalties of suspension of erring jockeys who have earlier appealed their cases but were not resolved in their favor by the Commission and are now serving their penalties, subject to the payment of One Thousand Pesos (Php1,000.00) if decision is favorable, in addition to the appeal fee of Five Hundred Pesos (Php500.00) already paid within the 72-hour-period to appeal;

NOW THEREFORE, the Philracom Board of Commissioners approves, as it hereby approved, to allow the review of the penalties of suspension of erring jockeys who have earlier appealed their cases but were not resolved in their favor by the Commission and are now serving their penalties, subject to the payment of One Thousand Pesos (Php1,000.00) if decision is favorable, in addition to the appeal fee of Five Hundred Pesos (Php500.00) already paid within the 72-hour-period to appeal;

RESOLVE FINALLY, that this Resolution be published in Kopya and the Official Gazette and be announced in the television for proper guidance of those concerned.
