[ PHILRACOM RESOLUTION NO. 24-10, August 19, 2010 ]

PENALTIES AND SANCTIONS FOR ERRING JOCKEYS



WHEREAS, the Philippine Racing Commission (PHILRACOM) has the exclusive jurisdiction and control over the conduct of horseracing including the framing and scheduling of races, the construction and safety of horse-racing, the allocation of prizes and the security of racing as provided in Presidential Decree No. 420;

WHEREAS, pursuant to the said mandate, the PHILRACOM Board of Commissioners have the power to impose penalties such as, but not limited to, fines and disqualification;

WHEREAS, there are petitions from jockeys received by the PHILRACOM Board of Commissioners requesting for the review and reconsideration of their penalties and suspension even if they are already serving the same because (1) their appeals filed within 72-hour period were denied by the Commission, or (2) they failed to appeal within the 72-hour and chose to serve the penalty imposed upon them;

WHEREAS, in the interest of justice and for humanitarian reasons, the PHILRACOM Board of Commissioners has decided to allow, subject to the following condition, the review of the penalties of suspension of erring jockeys (1) who have earlier appealed their cases but were denied by the Commission and are now serving their penalties, subject to the additional payment of reconsideration/review fee of Five Hundred Pesos (Php 500.00) in addition to the appeal fee of Five Hundred Pesos (Php 500.00) already paid within 72-hour period to appeal; (2) who have failed to appeal within 72-hour period and chose to serve the penalty imposed upon them subject to the payment of reconsideration/ review fee of One Thousand Pesos (Php 1,000.00);

NOW, THEREFORE, the PHILRACOM Board of Commissioners approves, as it hereby approved, to allow subject to the following conditions, the review of the penalties of suspension of erring jockeys (1) who have earlier appealed their cases but were denied by the Commission and are now serving their penalties, subject to the additional payment of reconsideration/review fee of Five Hundred Pesos (Php 500.00) in addition to the appeal fee of Five Hundred Pesos (Php 500.00) already paid within 72-hour period to appeal; (2) who have failed to appeal within 72-hour period and chose to serve the penalty imposed upon them subject to the payment of reconsideration/review fee of One Thousand Pesos (Php 1,000.00);

RESOLVE, FURTHER, that Board Resolution Nos. 21 and 23 Series of 2010 and other related Resolution/s that are/is in conflict with the intent of this Resolution shall be considered revoked or amended.

RESOLVE FINALLY, that this Resolution be published in the Kopya and the Official Gazette and be announced in the television for proper guidance of those concerned.
